Introduction

The prevention and control of noise pollution is closely related to the people's lives, is the most beneficial part of the people's well-being, and is an important part of the construction of ecological civilization.  

 

1、 General requirements

(1) Guiding ideology
  With the focus of "laying a good technical foundation, making up for the weak points in the field, strengthening the weak points in the mechanism, and grasping the implementation of responsibilities", we will accelerate the solution of the prominent noise pollution problems of concern to the people, continue to promote the improvement of the acoustic environment quality during the "14th Five-Year Plan" period, and constantly improve the people's sense of ecological environment gain, happiness, and security.

(2) Basic principles
Adhere to the principle of people first and focus on key points. In view of the prominent noise pollution problems of concern to the masses, we should strengthen the prevention at the source, strictly control the transmission, focus on the protection of receptors, encourage the construction of quiet areas, optimize the way of dispute resolution, and gradually meet the needs of the people for a peaceful and harmonious living environment.
Adhere to problem-oriented and classified control. In combination with the characteristics of industrial noise, construction noise, traffic noise and social life noise, the responsibility system shall be strictly implemented, the supervision of key areas shall be refined, the typical demonstration and guidance shall be encouraged, and the scientific, rational and effective noise pollution control shall be improved.
We should strive for progress while maintaining stability and implement comprehensive policies. Follow the objective laws of noise pollution prevention and control, based on the current stage of control, pay close attention to policies, standards, management and other requirements, enrich awareness, behavior, habits and other measures, step by step, take multiple measures simultaneously, and promote the improvement of noise pollution prevention and control level in stages and steps.
Adhere to the principle of joint management and social governance. Give full play to the institutional advantages, strengthen the coordination between departments, strengthen the linkage between the upper and lower levels, enhance the public participation, promote the implementation of the responsibility for noise pollution prevention and control level by level, mobilize the forces of the whole society to gather together for governance, and strive to build a good situation in which government supervision, corporate governance, social organizations and the public participate together.

(3) Main objectives
Through the implementation of noise pollution prevention and control actions, we have basically grasped the pollution status of key noise sources, constantly improved the noise pollution prevention and control management system, effectively implemented the pollution control responsibility, steadily improved the control level, continuously improved the quality of the acoustic environment, and gradually formed a peaceful and harmonious civilization awareness and social atmosphere. By 2025, the nighttime compliance rate of the national acoustic environment functional zone will reach 85%.  

 

2、 Consolidate the foundation of acoustic environment management and promote continuous improvement

(4) Scientific delimitation of acoustic environment functional areas
1. Carry out the delimitation and assessment of the acoustic environment function area. Guide the local authorities to delimit and adjust the acoustic environment function zones in time according to the national acoustic environment quality standards, the land space planning and the current situation of land use. Carry out the assessment of the division of acoustic environmental functional areas. By the end of June 2023, municipalities directly under the Central Government, provincial capital cities and cities specifically designated in the state plan will complete the assessment; By the end of 2023, other district-level cities will complete the assessment.
2. Promote the delimitation of concentrated areas of noise-sensitive buildings. Study the requirements for the delimitation of concentrated areas of noise-sensitive buildings, and guide the local authorities to carry out the delimitation of concentrated areas of noise-sensitive buildings in accordance with the Noise Law, in combination with the national acoustic environmental quality standards, territorial space planning and related planning, and the layout of noise-sensitive buildings. According to the needs of acoustic environment management, all localities can carry out the first trial, adhere to the principle of "easy first, then difficult", and make steady progress.

 

(5) Detailed acoustic environment management measures
3. Release noise pollution prevention information. Periodically release the national acoustic environment quality information, and print and issue the annual noise pollution prevention and control report in China. From 2025, the provincial competent department of ecological environment will publicly release the information on the quality of acoustic environment and the report on the prevention and control of noise pollution in its administrative area.
4. Promote the implementation of local acoustic environmental quality improvement responsibilities. The guidelines for the preparation of the acoustic environment quality improvement plan were issued to guide the people's governments of cities and counties with districts where the areas that did not meet the national acoustic environment quality standards to prepare the acoustic environment quality improvement plan and its implementation plan. The pilot project of urban noise control evaluation will be carried out, and the noise-related planning and implementation of the acoustic environment quality improvement plan, the acoustic environment quality status, noise monitoring and supervision, and pollution prevention and control will be included as the important content of urban ecological environment control evaluation, and will be included in the establishment of ecological civilization construction demonstration cities and counties. We will carry out the pilot application of urban noise maps and establish a real-time monitoring network for urban noise in the pilot cities. Cities with conditions are encouraged to strengthen the precise control of noise pollution prevention and control by relying on information means such as noise map and noise tracing.

 

 

3、 Strict noise source management and control new pollution

(6) Scientific delimitation of acoustic environment functional areas
5. Improve the planning requirements. When formulating or revising the territorial space planning, transportation planning and related planning, the layout between large-scale transportation infrastructure, industrial concentration area and noise-sensitive building concentration area should be reasonably arranged, and the relevant requirements for noise and vibration pollution prevention and control should be implemented.
6. Refine the requirements for route selection and location of transportation infrastructure. Study and formulate the Opinions on Deepening the Construction of Green Roads, take the requirements of noise pollution prevention and control as an important part of the high-quality development of green roads, beautiful roads and highway construction, scientifically select routes and wiring, and try to avoid areas where noise-sensitive buildings are concentrated. Promote the reconstruction of existing railways and the relocation of freight railways crossing the central urban area as a whole, and the new railway projects should try to avoid the areas where noise-sensitive buildings are concentrated. We will improve the coordination mechanism for the selection of civil airport sites, the approval of the overall plan, and the preparation of relevant plans for the airport and its surrounding areas, and implement the planning and control of the prohibited and restricted construction areas of noise-sensitive buildings around the airport.
7. Optimize the construction layout of noise-sensitive buildings. When building noise-sensitive buildings on both sides of the main traffic line and around industrial enterprises, a certain distance should be set aside and corresponding planning and design requirements should be put forward. Scientifically plan the location of noise-sensitive buildings such as houses and schools to avoid the impact of surrounding noise; Primary and secondary schools should reasonably arrange playgrounds and other extracurricular activities, strengthen the management of in-school broadcasting, and reduce the impact on the surrounding environment. The sound insulation design, detection and acceptance of noise-sensitive buildings shall comply with the requirements of relevant standards such as the General Code for Building Environment and the Code for Sound Insulation Design of Civil Buildings.

 

(7) Overall control of noise sources
8. Strictly implement the noise pollution prevention requirements. When formulating and revising relevant plans and constructing projects that have an impact on the environment, the environmental impact assessment shall be carried out according to law, the impact of noise and vibration shall be analyzed, predicted and evaluated, and the noise pollution prevention and control measures shall be actively taken. The noise pollution prevention and control facilities of a construction project shall be designed, constructed and put into operation at the same time as the main works. Supervise and urge the construction unit to carry out the environmental protection acceptance for completion according to law, and strengthen the supervision after the event to ensure the implementation and effectiveness of various measures.
9. Pay close attention to product quality supervision. Timely update the national key industrial product quality and safety supervision directory; Organize the supervision and spot check on the production and sales of key products with national noise limit standards, update the implementation rules of spot check, and timely publish the results to the public; Organize the detection of the noise emitted by special equipment such as elevators; Continue to strengthen the certification and supervision of noise pollution of automobiles and motorcycles, and incorporate relevant national standards into compulsory certification in due course.
10. Promote advanced technology. Encourage the research, development, promotion and application of low-noise processes and equipment, timely update the industrial structure adjustment guidance directory and the national advanced pollution prevention and control technology directory in the field of noise and vibration pollution prevention, and promote the green and high-quality development of relevant industries.

 

4、 Deepen the prevention and control of noise pollution in industrial enterprises and strengthen the supervision of key enterprises

(8) Strict industrial noise management
11. Establish a benchmark for industrial noise pollution control. Industrial enterprises that emit noise should take effective measures to reduce vibration and noise, strengthen the management of noise sources such as fixed equipment, means of transport, cargo handling, etc. in the plant, and avoid sudden noise disturbance. Enterprises are encouraged to adopt advanced treatment technologies to create a demonstration model of industrial noise pollution treatment. Central enterprises should take the initiative to assume social responsibilities, give full play to the exemplary and exemplary role, and create a number of industry benchmarks.
12. Strengthen the control of industrial parks. Encourage industrial parks to control noise pollution by zones, optimize equipment layout and logistics transportation routes, and use low-noise equipment and transportation tools. Strictly control the transfer of industrial enterprises with serious noise pollution to rural residential areas.

(9) Implement key enterprise supervision
13. Promote the implementation of emission permits and management of key emission units for industrial noise. Issue the application and technical specifications for industrial noise emission permit, issue the emission permit or carry out the emission registration according to law, and strengthen the supervision; Units that implement the management of pollutant discharge permit shall discharge pollutants according to the permit, carry out self-monitoring and make it public in accordance with the regulations. In accordance with the Measures for the Administration of the List of Key Units of Environmental Supervision, promote the competent ecological and environmental departments at or above the municipal level divided into districts to compile the list of key noise emission units in their administrative areas, and publish and update it as required; Key noise emission units shall carry out automatic noise monitoring in accordance with the law, and timely connect with the monitoring equipment of the competent department of ecological environment.

 

 

5、 Strengthen the prevention and control of construction noise pollution, and strictly control the construction at night
 

(10) Detailed construction management measures
14. Promote low-noise construction equipment. Formulate a list of prohibited and restricted technologies for housing construction and municipal infrastructure projects, and restrict or prohibit backward construction technologies and equipment that are prone to generate noise pollution. Before the end of May 2023, the guide catalogue of low-noise construction equipment will be issued.
15. Implement control responsibilities. Revise the model text of the construction contract of the construction project to clarify the requirements of the construction unit and the construction unit for noise pollution prevention and control responsibilities, tasks and measures. The construction unit shall prepare and implement the work plan for noise pollution prevention and control, and adopt effective sound insulation and noise reduction equipment, facilities or construction technology. Encourage the classified and hierarchical management of noise pollution prevention and control demonstration sites, and explore ways to promote construction enterprises to strengthen the prevention and control of noise pollution from the aspects of evaluation of excellence and financial subsidies.

(11) Focus on key points of construction management
16. Strengthen the construction requirements for the concentrated area of noise-sensitive buildings. The construction site in the area where noise-sensitive buildings are concentrated should give priority to the use of low-noise construction technology and equipment, take vibration and noise reduction measures, and strengthen the management of transport vehicles entering and leaving the site; The construction unit shall set up an automatic noise monitoring system in accordance with the national regulations and connect it with the supervision and management department. Promote the local government to improve the requirements for the application, review, time limit and construction management of night construction certificates in areas where noise-sensitive buildings are concentrated, and strictly regulate the issuance of night construction certificates. The construction unit at night shall make public announcement according to law.

 

6、 Strengthen the prevention and control of traffic noise pollution and promote the step-by-step treatment in all fields

(12) Strengthen the prevention and control of vehicle and ship road noise pollution
17. Strictly supervise motor vehicles. Taking into account the needs of traffic travel, acoustic environment protection, etc., scientifically demarcate the road sections and times where motor vehicles are prohibited to drive and use loudspeakers and other acoustic devices, set up relevant signs and markings according to law, and announce to the public. It is encouraged to set up automatic recording system for illegal honking of motor vehicles in the road sections where honking is prohibited, and capture the violations of honking regulations by motor vehicles. It is prohibited to drive a motor vehicle that has been refitted without authorization, such as removing or damaging the muffler or installing an exhaust pipe, to cause noise pollution by roaring and speeding.
18. Promote ship noise pollution control. Strengthen the supervision of the noise of inland ships and promote the application of clean energy to inland ships; We will promote the use of shore power for ships berthing at ports, and organize the implementation of the transformation and use of shore power facilities and ship power receiving facilities in key waterway transport areas such as the Yangtze River Basin, the Bohai Bay, and the Qiongzhou Strait.
19. Strengthen the maintenance of roads and urban roads. Strengthen the maintenance of roads and urban road pavements and bridges, as well as the inspection, maintenance and maintenance of existing noise pollution prevention facilities such as road and urban road noise barriers, to ensure that they are always in good technical condition.

(13) Promote the prevention and control of rail traffic noise pollution
20. Standardize the prevention and control of urban rail transit noise pollution. The selection of equipment such as urban rail transit vehicles and the construction of rail lines and subgrade structures shall meet relevant requirements. The urban rail transit operation unit shall strengthen the maintenance of urban rail transit lines and vehicles, carry out noise monitoring and fault diagnosis according to regulations, keep the original monitoring records, and maintain the normal operation of vibration and noise reduction facilities.
21. Refine railway noise pollution prevention requirements. Define the department responsible for the prevention and control of noise pollution of the railway supervision and management organization, refine the railway noise pollution control measures, establish a working contact mechanism with railway transport enterprises and relevant departments, and strengthen industry supervision. Railway transport enterprises, together with local relevant departments, promote the comprehensive treatment of railway train whistle noise pollution, and promote the transformation of urban railway crossings into overpasses; Strengthen the maintenance of railway lines and rolling stock, ensure the normal operation of vibration and noise reduction facilities, carry out noise monitoring in accordance with national regulations, and keep the original monitoring records. It is encouraged to set up closed protective fences on both sides of the railway passing through the central urban area.
 

(14) Deepen the prevention and control of noise pollution around civil airports
22. Implement coordination, control and policy guidance. Promote the establishment of a collaborative management and control mechanism for civil airport management organizations, air transport enterprises, general aviation enterprises, air traffic management departments and other units. Formulate the implementation plan for reducing the noise of civil aircraft around the airport, and strive to build a comprehensive control system for civil aircraft noise pollution.
23. Carry out research on the prevention and control of civil aircraft noise pollution. Promote research on the generation mechanism of civil aircraft noise, the impact of civil transport airport noise, the relationship between aircraft power-noise-distance, and the drawing of civil aircraft noise map, and promote the independent research and development of civil aircraft noise impact simulation and prediction system. Improve the monitoring and traceability capability of civil aircraft noise events. By the end of 2025, airports with an annual passenger throughput of more than 5 million people will basically have the real-time monitoring capability of civil aircraft noise events, and the relevant results will be submitted to the competent civil aviation and ecological environment authorities.

 

7、 Promote the prevention and control of noise pollution in social life and improve corresponding management measures

(15) Optimize noise control in the business place
24. Strictly manage the noise in the business site. Guide the local authorities to strengthen supervision over enterprises, institutions and other business managers that use equipment and facilities that may cause noise pollution in social life, and prevent and reduce noise pollution by adopting optimized layout, centralized emission, use of vibration and noise reduction measures and strengthening maintenance. Commercial operators such as cultural entertainment, sports and catering should also take effective noise reduction measures for other noises generated in business activities.
25. Create a peaceful atmosphere in cultural places. The site selection and indoor acoustic environment of cultural places such as libraries and art galleries shall meet the requirements of corresponding design specifications; A quiet control area shall be set up inside the site according to the situation, and warning signs and management regulations for keeping quiet shall be posted.

(16) Strengthen noise supervision in public places
26. Refine the management requirements of public places. Guide the local authorities to strengthen the management of noise pollution activities such as entertainment, promotion, square dance, physical exercise, etc. organized or carried out in public places such as streets, squares and parks. The management of public places should clarify the control requirements for areas, time periods, volume, etc., and set up automatic noise monitoring and display facilities as required. If conditions permit, they can be connected with the local noise pollution prevention and control supervision and management department.
27. Civilized entertainment and tourism activities. Promote local and industrial organizations to issue square dance activity initiatives or civilized conventions, strengthen the self-discipline management of square dance lovers, consciously abide by the relevant provisions of the Noise Law, and avoid interfering with other people's normal life, work and study. The prevention and control of noise pollution shall be included in the propaganda of civilized tourism, and the propaganda tips shall be carried out before holidays; Promote tourist attractions to reduce the use of public address equipment in the interpretation service, and advocate guides to introduce the tranquility of public places to tourists.

(17) Improve community and neighborhood noise management measures
28. Promote the disclosure of noise related information of new residential housing. Revise the model text of the commercial housing sales contract, add the possible impact of indoor and outdoor noise on the housing, the preventive measures taken or proposed to be taken, and the location of the housing common facilities and equipment. Promote the real estate development operators to publicize the possible noise impact on the housing and the corresponding prevention and control measures in the sales place.
29. Refine the noise control in residential areas. The elevators, pumps, transformers and other common facilities and equipment installed in the new residential area shall meet the requirements of the relevant standards for sound insulation design of civil buildings. Effective measures should be taken for interior decoration activities and meet the requirements of operation time. The property management unit should inform the decorator and the decoration enterprises entrusted by the decorator of the relevant prohibited behaviors and precautions, and do a good job of inspection, and report the problems found in a timely manner.
30. Promote the construction of quiet communities. Printing and issuing guidance documents for the construction of tranquil communities, encouraging all localities to refine indicators according to actual conditions, calling on residential areas to spontaneously organize the construction of tranquil communities, improving residents' satisfaction, and promoting them to the society. Encourage quiet communities to set up automatic noise monitoring and display facilities.
31. Encourage community residents to manage themselves. Strengthen the construction of the environmental and property management committee of the community residents committee, and give full play to the active role of the community residents committee in guiding the owner committee, property service personnel, owners, etc. to do a good job in noise pollution prevention. Strengthen the training of urban and rural community workers, incorporate the Noise Law into the training content, and enhance the ability of grass-roots mass autonomous organizations to publicize relevant laws, regulations and knowledge on noise pollution prevention and control, and mediate and deal with noise disputes.

 

8、 Improve the system of laws, regulations and standards, and give full play to the supporting role of science and technology education

(18) Improve laws, regulations, standards and specifications
32. Promote the improvement of relevant laws and regulations. In the process of revising relevant laws and regulations, such as the Law on Public Security Management and Punishment, the Law on Road Traffic Safety, the Regulations on Civil Airport Management, and the Administrative Measures on Entertainment Places, the Law should be effectively connected with the Noise Law. We will promote the construction of local legislation and supporting systems for the prevention and control of noise pollution.
33. Improve the ecological environment standards for noise and vibration. Accelerate the revision of quality standards for aircraft noise and environmental vibration in urban areas around the airport, promote the formulation and revision of noise emission control standards for railway boundary, building construction, urban rail transit, etc., study and develop supporting management technical specifications and guidelines for the division of noise control areas around the airport, the application of noise and vibration pollution prevention technology, and develop industrial noise Code for automatic monitoring of construction noise and aircraft noise monitoring around the airport.
34. Promote the formulation and revision of standards for products and engineering construction. Promote the formulation and revision of noise limit standards and product technical specifications for railway locomotives, civil aircraft, earth-moving machinery, grain combine harvesters, tractors, household and similar electrical appliances, elevators and other products. Promote the formulation and revision of engineering technical specifications for highways and railways, technical specifications for noise barriers for highways and railways, specifications for pavement noise detection, specifications for residential projects, and specifications for sound insulation design of civil buildings, etc., and clarify the requirements for noise pollution prevention and control.

 

(19) Strengthen noise supervision in public places
35. Strengthen scientific research education and talent training. Carry out scientific research on noise and vibration pollution prevention and monitoring. In the legal education of primary and secondary schools, the relevant content of noise pollution prevention and control should be added to cultivate students' good habits of reducing noise in the family and public places, and establish the awareness of not disturbing others. Promote relevant colleges and universities to offer courses related to noise and vibration pollution prevention. Vigorously cultivate professional and technical leaders and young top talents in the field of noise and vibration pollution prevention, improve the technical level and ability of employees, and strengthen forward-looking research.
36. Promote the transformation of scientific and technological achievements. Relying on relevant high-level scientific research platforms, we will promote the establishment of a technological innovation system for noise and vibration pollution prevention and control with enterprises as the main body, market as the guide, and in-depth integration of production, education and research, and promote the national comprehensive service platform for the transformation of scientific and technological achievements in the ecological environment, as well as relevant key laboratories and engineering research centers, to carry out the demonstration, transfer, transformation, promotion and application of scientific and technological achievements. Promote the construction of acoustic industrial park.

 

9、 Systematically promote noise monitoring and strictly supervise law enforcement

(20) Improve noise monitoring capability
37. Strengthen law enforcement in the field of noise pollution prevention and control. Include law-enforcement activities related to noise pollution prevention and control into the law enforcement inspection plan, implement "double random and one open" supervision, innovate supervision means and mechanisms, and strictly investigate and deal with illegal acts according to law. Strengthen the communication and coordination between the law enforcement departments concerned with the prevention and control of noise pollution and with the judicial authorities, establish and improve the linkage mechanism, and improve the efficiency of law enforcement and the level of administration according to law.
38. Improve grassroots law enforcement capacity. Provide portable noise monitoring equipment for relevant law enforcement teams and promote the use of new technologies, equipment and methods in the process of law enforcement. To improve the law enforcement monitoring mechanism, we can encourage qualified, competent and creditworthy social testing institutions to participate in the auxiliary law enforcement monitoring work according to the work needs.
39. Carry out noise monitoring value traceability. Strengthen the construction of measurement base standards related to noise monitoring, do a good job in the verification and calibration of noise monitoring instruments, formulate relevant national measurement technical specifications for noise monitoring and detection instruments, and effectively support the evaluation of acoustic environment quality and noise pollution control.
 

(21) Strengthen law enforcement and supervision
40. Strengthen law enforcement in the field of noise pollution prevention and control. Include law-enforcement activities related to noise pollution prevention and control into the law enforcement inspection plan, implement "double random and one open" supervision, innovate supervision means and mechanisms, and strictly investigate and deal with illegal acts according to law. Strengthen the communication and coordination between the law enforcement departments concerned with the prevention and control of noise pollution and with the judicial authorities, establish and improve the linkage mechanism, and improve the efficiency of law enforcement and the level of administration according to law.
41. Improve grassroots law enforcement capacity. Provide portable noise monitoring equipment for relevant law enforcement teams and promote the use of new technologies, equipment and methods in the process of law enforcement. 10、 Grasp the implementation of responsibilities and guide the people to govern together

42. Promote the synergy of noise pollution prevention and control. Local people's governments at all levels are responsible for the quality of the acoustic environment in their respective administrative areas and take effective measures to improve the quality of the acoustic environment. All localities shall, in combination with the actual needs of noise pollution prevention and control management, clarify the supervision and management responsibilities of relevant departments for noise pollution prevention and control, determine the industry directors, law enforcement bodies, responsible units and complaint reporting methods, and make them public to the public; If the division of labor has been clearly defined according to law, it shall continue to be implemented. All localities shall organize and establish the coordination and linkage mechanism for noise pollution prevention and control according to the management needs, and strengthen the coordination, linkage and information sharing. In combination with local conditions, promote the formulation of the action plan or implementation plan for noise pollution prevention and control in the administrative region, clarify the task objectives, and refine the measures and requirements.
43. Optimize noise dispute resolution. The grass-roots mass autonomous organizations, owners' committees and property service providers shall promptly dissuade and mediate the disturbance of social life noise in areas where noise-sensitive buildings are concentrated; If the dissuasion or mediation fails, it may report or complain to the department responsible for supervision and management or the department designated by the government, and the department receiving the report or complaint shall handle it according to law; Those who, after dissuasion, mediation and treatment, fail to stop the noise disturbing behavior and continue to interfere with the normal life, work and study of others, or have other violations of public security management such as disturbing public order and social management, shall be punished by the public security organ according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
44. Strict assessment and accountability. Incorporate the completion of noise pollution prevention and control objectives into relevant assessment contents and formulate assessment requirements. For areas that fail to meet the assessment objectives and targets set in the acoustic environment quality improvement plan, as well as areas with prominent noise pollution problems and strong public response, they shall be interviewed according to law and rectified within a time limit.

 

(23) Promote the construction of noise pollution prevention team
45. Strengthen the management of noise pollution prevention and control and the construction of technical team. Establish a multi-level expert database, strengthen training, strengthen the management of administrative law enforcement qualifications of law enforcement personnel, improve the support capacity of social testing and engineering, technical services and other institutions through market guidance and department supervision, and standardize the market operation behavior of relevant institutions.
46. It is encouraged to commend advanced units and individuals. Propagandize and popularize the Noise Law in various forms, interpret the provisions in plain language, and explain the provisions in vivid and concrete cases, so as to enhance the law-abiding awareness of various legal subjects. Promote grass-roots mass autonomous organizations to carry out noise pollution prevention and control propaganda, and guide the public to consciously reduce noise emissions. Encourage scientific research institutions and laboratories related to noise pollution prevention and control to open to the public, carry out popularization activities such as public lecture halls into schools, communities and enterprises, and call on social organizations, public place managers, volunteers, etc. to widely publicize relevant laws and regulations to the public
