Japan will launch the "strictest" management on PFHxS and its salts, and related products will be banned and delisted!
On February 18, 2023, the Ministry of Health, Labor, Economy and Industry, and the Ministry of Environment of Japan jointly issued a notice for soliciting opinions, planning to amend the Implementation Order of the Chemical Examination Law, add PFHxS and its salts as the "first specific chemical substance" under the Chemical Examination Law, and set "import prohibition rules for some related products" and "use prohibition rules for other than designated purposes". The deadline for soliciting opinions was March 19.
PFHxS, its salts and related compounds were included in the Stockholm Convention Annex A Persistent Organic Matter Elimination List in 2022. As a performing country, Japan has been studying the revision of its domestic law to fulfill its obligations under the Convention.
However, for PFHxS-related compounds, Japanese officials believe that the list of sample substances given by the United Nations Persistent Organic Pollutants Review Committee (POPRC) is still controversial, and decided to postpone the revision of domestic laws related to this part. Therefore, the object of this revision is limited to PFHxS and its salts.
The prohibition and restriction rules are as follows:
1. PFHxS and its salts will be designated as the "first specific chemical substance" under the Chemical Examination Law, and the manufacture and import of PFHxS will require official approval.
But in fact, only special purposes such as experimental research can apply for permission. Therefore, PFHxS and its salts will be banned in principle.
2. Some products that use PFHxS and its salts will be banned from import. include:
- Fire extinguisher, extinguishing agent for fire extinguisher and foam extinguishing agent
- Etching agent used in metal processing Surface treatment agent for electroplating or its preparation additive
- Clothes with water or oil resistance after treatment
- Clothing with waterproof or oil-proof property after treatment
- Floor coverings with water or oil resistance after treatment
- Water repellent, oil repellent and fiber protective agent
- Anti-reflective agents used in the manufacture of semiconductors
- Etchant for semiconductor manufacturing
- Corrosion inhibitor for semiconductor
3. It is planned to set "essential use", and PFHxS and its salts are prohibited to be used beyond this use. (The specific content of essential use is not disclosed in this consultation)
4. For fire extinguishers using PFHxS and its salts, inactivators for inactivators and foam inactivators, separate technical benchmarks need to be observed.
In addition, the revised official plan will be implemented in the first half of 2024.
