PFAS and polystyrene foam containers in food containers are prohibited in Oregon

In May 2023, the governor of Oregon, the United States, signed Act SB 543 into law to control the polystyrene foam container, polystyrene foam container, polystyrene foam packaging loose filler and PFAS in food containers used for prefabricated food.


Specific requirements include

  • Starting from January 1, 2025, no one shall sell, offer for sale, or distribute food containers in Oregon containing intentionally added perfluoroalkyl or polyfluoroalkyl substances (PFAS).
  • From January 1, 2025, food suppliers shall not use polystyrene foam containers to sell, provide for sale, supply or distribute prefabricated food to consumers.
  • From January 1, 2025, no one shall sell, provide for sale or distribute polystyrene foam containers or polystyrene foam packaging loose fillers in Oregon.

 

Note:
Food containers "include bowls, plates, cups, lids, flip packaging boxes, or other containers, or any other items used to provide or hold prefabricated food, including takeaway food and leftovers prepared by food suppliers for partial consumption.
