The EU has confirmed the inclusion of PFHxS substances in POPs regulations

European Commission announced its decision to adopt a proposal to amend Annex I of Regulation (EU) 2019/1021, which includes PFHxS, its salts, and related compounds in the list of prohibited substances under the POPs regulation.
On May 30, 2023, the European Commission announced its decision to adopt a proposal to amend Annex I of Regulation (EU) 2019/1021, which includes PFHxS, its salts, and related compounds in the list of prohibited substances under the POPs regulation. This is to implement the EU's international commitment to persistent organic pollutants under the Stockholm Convention. The list of prohibited substances in Annex I of the EU POPs regulation will also be increased from 28 to 29.
The draft proposes to add the following entry to Part A of Annex I of the EU POPs regulation, and it is expected that this control requirement will be officially published in the official gazette shortly.
1、 Substance name
Perfluorohexane sulfonic acid (PFHxS) and its salts and related compounds
Perfluorohexane sulfonic acid (PFHxS) and its salts and PFHxS related compounds refer to the following:
(1) Perfluorohexane sulfonic acid, including any branched isomers thereof;
(2) Its salts;
(3) PFHxS related compounds: For the purpose of the Convention, any substance containing C6F13S chemical components as one of its structural elements that can be degraded into PFHxS.

3、 Special exemptions for intermediate use or other regulations
1. For the purpose of this entry, point (b) of Article 4 (1) applies to the concentration of PFHxS or any of its salts in a substance, mixture or article ≤ 0.025 mg/kg (0.0000025%).
For the purpose of this article, point (b) of Article 4 (1) shall apply to the concentration of all PFHxS related substances in a substance, mixture or article, with a total concentration ≤ 1 mg/kg (0.0001%).
3. For the purpose of this entry, point (b) of Article 4 (1) shall apply to the concentration of PFHxS and PFHxS related compounds ≤ 0.1 mg/kg (0.00001%) when used in concentrated fire foam mixtures or used in the production of other fire foam mixtures. This exemption shall be reviewed by the Committee within 3 years after it takes effect to reduce the limit.
