Big move! Australia Completely Ban Multiple Brominated Flame retardants

Recently, the Australian Department of Climate, Energy, Environment and Water Resources (DCCEEW) plans to include various brominated flame retardant chemicals in the Industrial Chemicals Environmental Management Standards (IChEMS) register.

1、 Substances proposed for inclusion in IChEMS Schedule 6 (i.e. industrial chemicals that may cause serious or irreversible environmental damage but have essential uses):

Risk management measures:

Starting from July 1, 2025, it is prohibited to import, export, manufacture, and use (whether used alone or in combination) this type of chemical substance, except for the following situations:

This type of chemical substance exists in the form of unintentional trace pollutants, that is, the sum of all non bromodiphenyl ether isomers or decabromodiphenyl ether is equal to or less than 10mg/kg;
Used for research or experimental purposes;
Holding relevant hazardous waste import and export licenses;
Used for the following important purposes and in accordance with relevant risk management measures:
Used for manufacturing aircraft parts before January 1, 2027 (until the end of the aircraft's service life)
Aircraft (until January 1, 2027)
Polyurethane foam for building thermal insulation (until January 1, 2027)
Electrical and electronic equipment (until January 1, 2027)
Used for manufacturing automotive parts before 2019 (until January 1, 2036)
Textiles that require flame retardant properties other than clothing and toys (until January 1, 2027).

Starting from July 1, 2025, it is prohibited to import, export, manufacture, and use items containing such chemical substances, except for the following situations:

Polybrominated diphenyl ethers (PBDEs) exist in the form of unavoidable trace pollutants in items, with a total amount equal to or less than 500mg/kg, including all tetrabromine, pentabromine, hexabromine, heptame, octabromine, nine bromine, and decabromodiphenyl ether homologues;
Used for research or experimental purposes;
Holding relevant hazardous waste import and export licenses;
The item was in use before July 1, 2025;
The important uses listed in clause d) above.

2、 Substances proposed for inclusion in IChEMS Schedule 7 (i.e. industrial chemicals that may cause serious or irreversible environmental damage and do not have essential uses):

（1） Polybrominated diphenyl ethers (PBDEs)

Used for research or experimental purposes;
Hold relevant hazardous waste import and export licenses.

Starting from July 1, 2024, it is prohibited to import, export, manufacture, and use items containing such chemical substances, except for the following situations:

Polybrominated diphenyl ethers (PBDEs) exist in the form of unavoidable trace pollutants in items, with a total amount equal to or less than 500mg/kg, including all tetrabromine, pentabromine, hexabromine, heptame, octabromine, nine bromine, and decabromodiphenyl ether homologues;
Used for research or experimental purposes;
Holding relevant hazardous waste import and export licenses;
The item was already in use before July 1, 2024.

2、 Hexabromocyclododecane (HBCDD)

Risk management measures:

Starting from July 1, 2024, it is prohibited to import, manufacture, and use (whether used alone or in combination) this type of chemical substance, except for the following situations:

This type of chemical substance exists in the form of unintentional trace pollutants, where the total of all homologues is equal to or less than 100mg/kg (for example, the total of all tetrabromodiphenyl ether homologues is equal to or less than 10mg/kg);
Used for research or experimental purposes;
Hold relevant hazardous waste import and export licenses.

Starting from July 1, 2024, it is prohibited to import, manufacture, and use items containing such chemicals, except for the following situations:

Hexabromocyclododecane (HBCDD) exists in the form of unavoidable trace pollutants in items, with a total amount equal to or less than 100mg/kg;
Used for research or experimental purposes;
Holding relevant hazardous waste import and export licenses;
The item was already in use before July 1, 2024.
