EU POPs plan to lower control limits for hexabromocyclododecane

The EU POPs plan to lower the control limit of hexabromocyclododecane from the previous 100 mg/kg to 75 mg/kg.

On November 28, 2023, the European Union released the revised draft of POPs Regulation (EU) 2019/1021, proposing to lower the HBCDD (hexabromocyclododecane) limit from the previous 100 mg/kg to 75 mg/kg, unless it is EPS and XPS insulation materials used in construction or civil engineering, and these materials use recycled polystyrene in production. The feedback period for this draft will end on December 26, 2023.

 

 

The current regulations and revised draft of HBCDD are compared as follows:

For the purpose of this provision, Article 4 (1) (b) applies to substances, preparations, articles, or flame retardant products with a concentration of hexabromocyclododecane equal to or less than 100 mg/kg (0.01% by weight), which will be reviewed by the Committee before March 22, 2019.


Expanded polystyrene items produced before February 21, 2018 and used in construction, in compliance with Regulation (EU) 2016/293 and Resolution 2016/C12/06, and foamed polystyrene items containing hexabromocyclododecane components produced before June 23, 2016 and used in construction, may continue to be used. The third and fourth paragraphs of Article 4 (2) apply to this type of item.


Without affecting other EU regulations on the classification, packaging, and labeling of substances and mixtures, expanded polystyrene containing hexabromocyclododecane components that were put on the market after March 23, 2016 should be identified through labeling or other means throughout its entire lifecycle.

For the purpose of this article, Article 4 (1) (b) shall apply to situations where the concentration of hexabromocyclododecane in a substance, mixture, article, or as a flame retardant component is equal to or less than 75 mg/kg (0.0075% by weight). For EPS and XPS insulation materials used in construction or civil engineering, which use recycled polystyrene in production, point (b) should apply to hexabromocyclododecane concentrations equal to or less than 100 mg/kg (0.01% by weight). The European Commission should review and evaluate the exemptions specified in point (1) before January 1, 2026.


Expanded polystyrene items produced before February 21, 2018 and used in construction, in compliance with Regulation (EU) 2016/293 and Resolution 2016/C12/06, and foamed polystyrene items containing hexabromocyclododecane components produced before June 23, 2016 and used in construction, may continue to be used. The third and fourth paragraphs of Article 4 (2) apply to this type of item.


Without affecting other EU regulations on the classification, packaging, and labeling of substances and mixtures, expanded polystyrene containing hexabromocyclododecane components that were put on the market after March 23, 2016 should be identified through labeling or other means throughout its entire lifecycle.
