OEHHA Fourth Proposal to Revise California 65 Warning Label

On June 17, 2024, the California Office of Environmental Health Hazard Assessment (OEHHA) proposed for the fourth time to revise the short format warning labels in Chapter 6 of California Regulation 65, Clear and Reasonable Warning Labels, to make the content of the warning labels more informative to consumers.

Public comments will be closed on June 28, 2024.
OEHHA has established safe harbor warnings for products, and businesses use these warning labels to inform consumers of exposure to chemicals listed on the California 65 Chemical List. OEHHA specifies safe harbor (full format) warning labels and short format warning labels for consumer goods, with the short format warning labels intended for use on small packaging or labels. The current short format warning labels do not require specific chemical exposure to be displayed in the warning. OEHHA has noticed that this short format warning label is overused and the warning message does not provide consumers with information about the chemicals listed in the product.
OEHHA proposed to modify the California 65 short format warning label for three consecutive years in 2021, 2022, and 2023, but these suggestions were not implemented. The summary of the proposed modifications for this OEHHA is as follows:
- Increase the implementation time (transition period) of the revised brief warning content from two years to three years;
- Restore most Internet and directory warnings to the original regulatory text, and add a new provision that provides Internet retailers with a 60 day grace period (from the date they receive the warning or a written notice to change the new warning content) within the three-year implementation period to update the short warnings on their websites.
For ordinary consumer goods, a comparison between the current short format warning labels and this proposal (for example, different chemical substances have different hazard attributes, and the specific hazard attributes are based on the actual chemical substance):
