Starting from November 2024, new environmental regulations and standards will be implemented nationwide and in multiple regions, covering regulatory review, foreign investment, import of renewable resources, pollution management, compensation for ecological environment damage, construction waste disposal, oil fume testing, etc., to strengthen environmental protection and supervision.
Starting from November 2024, a new batch of environmental laws and regulations, as well as environmental norms and standards, have been officially implemented. Come and learn more.
National documents and standards
1. Regulations on the Review of Filing of Regulations and Rules
In order to standardize the work of filing and reviewing regulations and rules, improve the ability and quality of filing and reviewing, strengthen the supervision of regulations and rules, and maintain the unity of socialist legal system, this regulation is formulated in accordance with the relevant provisions of the Legislation Law of the People's Republic of China. The regulations referred to in this regulation include departmental regulations and local government regulations. Departmental rules refer to the rules formulated by the ministries and commissions of the State Council, the People's Bank of China, the National Audit Office, the institutions directly under the State Council with administrative functions, and the institutions prescribed by law in accordance with the law and the administrative regulations, decisions, and orders of the State Council, within the scope of their authority, and in accordance with the Regulations on the Procedures for Formulating Rules and Regulations. This regulation shall come into effect on November 1, 2024.
2. Special Management Measures for Foreign Investment Access (Negative List) (2024 Edition)
The "Special Management Measures for Foreign Investment Access (Negative List)" uniformly lists special management measures for foreign investment access, such as equity requirements and executive requirements. Areas outside the Negative List for Foreign Investment Access shall be managed in accordance with the principle of consistency between domestic and foreign investment. Domestic and foreign investors shall uniformly apply the relevant provisions of the Negative List for Market Access. Overseas investors are not allowed to engage in investment and business activities as individual industrial and commercial households, sole proprietorship investors, or members of farmers' professional cooperatives. Effective from November 1, 2024.
3. Announcement on Regulating the Import Management of Recycled Copper and Copper Alloy Raw Materials, Recycled Aluminum and Aluminum Alloy Raw Materials
Recycled copper and aluminum raw materials that meet the requirements of the attached table are not considered solid waste and can be freely imported. Different types of recycled copper and aluminum raw materials in the attached table are not allowed to be mixed, and different types of recycled copper and aluminum raw materials are not allowed to be declared under the same customs declaration form during customs clearance; Bulk recycled copper and aluminum raw materials of different categories are not allowed to be mixed. When different categories of recycled copper and aluminum raw materials have independent packaging, they can be mixed, but they should be placed separately. This announcement shall come into effect on November 15, 2024.

1. Work Plan for Promoting the Linkage of Approval for the Setting of River Discharge Outlets and Environmental Impact Assessment Approval for Construction Projects in Shandong Province (Trial)
In order to continuously implement the reform requirements of "streamlining administration, delegating power, combining regulation and optimization of services", strengthen the linkage between the approval of the setting of sewage outlets into rivers and the approval of environmental impact assessments for construction projects, improve approval efficiency and service level, focus on promoting "efficient completion of one thing", and serve the high-quality development of the economy, this plan is formulated. This work plan will be implemented from November 1, 2024 and will be valid until October 31, 2027.
2. Implementation Measures for Ecological Environment Damage Compensation in Anhui Province
These measures shall come into effect on November 1, 2024.
3. Regulations on Ecological Environment Protection in Yunnan Province
In order to protect and improve the ecological environment, prevent and control environmental pollution, safeguard public health, create a leading force in ecological civilization construction, support high-quality development with high-quality ecological environment, and comprehensively promote the modernization of harmonious coexistence between man and nature through the construction of a beautiful Yunnan, this regulation is formulated in accordance with the Environmental Protection Law of the People's Republic of China and other laws and administrative regulations, combined with the actual situation of this province. This regulation shall come into effect on November 1, 2024.
4. Regulations on Construction Waste Management in Hainan Province
In order to strengthen the management of construction waste, promote source reduction and comprehensive utilization, protect and improve the ecological environment, and promote the development of circular economy, this regulation is formulated in accordance with relevant laws and regulations on solid waste pollution prevention and control, combined with the actual situation of this province. This regulation applies to the generation, collection, storage, transportation, utilization, disposal, and related supervision and management of construction waste within the administrative area of this province. This regulation shall come into effect on November 1, 2024.
5. Hainan Province landmark "Portable Laser Scattering Method for Determination of Oil Fume Pollutants" (DB46/T 641-2024)
This document specifies the portable laser scattering measurement method for oil fume pollutants. This document is applicable for the rapid determination of the concentration of oil fume pollutants in the exhaust of catering industry and other units that generate cooking fumes. The detection limit of this document is 0.1mg/㎡, and the lower limit of determination is 0.4mg/㎡. This standard shall come into effect on November 1, 2024.
6. Regulations on Construction Waste Management in Lhasa City
In order to strengthen the management of construction waste, promote the comprehensive utilization of construction waste, and advance the construction of an ecological civilization highland, this regulation is formulated in accordance with the Solid Waste Pollution Prevention and Control Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this city. This regulation applies to the generation, collection, storage, transportation, utilization, disposal, supervision and management of construction waste within the administrative area of this city. This regulation shall come into effect on November 1, 2024.
7. List of Comprehensive Management of Environmental Impact Assessment and Pollutant Discharge Permits for Construction Projects in Xiamen City
In order to strengthen the control of ecological environment zoning, scientifically guide various development, protection and construction activities, establish a differentiated classification management system for pollution impact and ecological impact construction projects, and promote high-quality development, this directory is formulated in accordance with relevant laws and regulations such as the Environmental Impact Assessment Law of the People's Republic of China and the Regulations on the Administration of Pollutant Discharge Permits. This directory is applicable to construction projects within the scope of Xiamen city that have been approved for environmental impact assessment documents or issued with pollutant discharge permits by the Xiamen ecological environment department; Construction projects approved by national or provincial ecological and environmental authorities shall still be executed in accordance with the regulations of the higher-level authorities. This directory will come into effect on November 1, 2024.
8. Jiangsu Province Safety Production Administrative Penalty Discretionary Power Benchmark
In order to standardize the reasonable and appropriate exercise of administrative penalty discretion by emergency management departments throughout the province, and in accordance with the Administrative Penalty Law, Administrative Penalty Measures for Safety Production Violations (formerly Order No. 15 of the State Administration of Work Safety), Interim Provisions on Administrative Discretionary Power Standards for Emergency Management (Order No. 12 of the Ministry of Emergency Management), as well as other relevant safety production laws, regulations, and rules, the "Jiangsu Province Safety Production Administrative Penalty Discretionary Power Standards" are formulated. These measures shall come into effect on November 1, 2024 and shall be valid for 5 years.
9. Technical Specification for Treatment of Black and Odorous Water Bodies in Rural Areas of Jiangxi Province (DB36T 60003-2024)
In order to implement the requirements of laws and regulations such as the Environmental Protection Law of the People's Republic of China, the Water Pollution Prevention and Control Law of the People's Republic of China, and the Guidelines for the Treatment of Black and Odorous Water Bodies in Rural Areas (Trial), scientifically guide the treatment of black and odorous water bodies in rural areas, prevent and control rural water pollution, improve the quality of rural water ecological environment, and enhance rural living environment, according to the cooperation agreement of the Central Region Standardization Strategic Cooperation Alliance and combined with the actual situation of the six provinces in central China, the Henan Provincial Administration for Market Regulation, the Shanxi Provincial Administration for Market Regulation, the Anhui Provincial Administration for Market Regulation, the Jiangxi Provincial Administration for Market Regulation, the Hubei Provincial Administration for Market Regulation, and the Hunan Provincial Administration for Market Regulation jointly organized the formulation of this document, which is applicable in the six provinces in central China. This standard shall come into effect on November 1, 2024.
10. Work Plan for Strengthening the Supervision and Management of Environmental Impact Assessment and Ecological Environment Monitoring (Inspection) Institutions in Bazhou (Trial)
In order to promote the supervision of environmental violations by people from all walks of life, further deepen the reform of the environmental impact assessment approval system, optimize the business environment, improve the market-oriented supervision system of environmental impact assessment and ecological environment inspection and testing institutions, strengthen the supervision of environmental impact assessment quality and environmental monitoring throughout the process, strengthen the problem tracing mechanism and accountability system, severely crack down on various environmental violations such as falsification of environmental impact assessment and monitoring data, and further improve the service quality of environmental impact assessment and ecological environment monitoring (testing) institutions, this plan is formulated in combination with the actual situation in Bazhou. This plan will be implemented on November 1, 2024, with a trial period of 2 years.
11. Trial Measures for the Management of Green Project Database in Shanghai
In order to support the transformation and application of green low-carbon and ecological environment technologies, as well as financial development, and to implement the relevant requirements of documents such as the "Implementation Opinions of the Shanghai Municipal Committee of the Communist Party of China and the Shanghai Municipal People's Government on Fully, Accurately, and Comprehensively Implementing the New Development Concept and Doing a Good Job in Carbon Peak and Carbon Neutrality", "Implementation Opinions on Accelerating the Construction of an International Green Finance Hub in Shanghai to Serve Carbon Peak and Carbon Neutrality Goals", and "Regulations on Promoting the Green Transformation of Shanghai's Development Mode", this city has established a green finance service platform and a green project library. To standardize the management of green project libraries, this method is formulated. These measures shall come into effect on November 1, 2024 and shall be valid for 2 years.
12. Several Measures for Further Optimizing the Environmental Supervision of Solid Waste and Improving the Level of Solid Waste Utilization and Disposal in Ningxia City
This measure is interpreted by the Department of Ecology and Environment of the autonomous region. Effective from November 10, 2024, and valid until December 31, 2027.
13. Notice on Supporting the Development of Low altitude Economy in Strong Civil Aviation Province and Strengthening the Guarantee of Natural Resource Factors in Zhejiang Province
In order to implement the spirit of the "Several Opinions of the People's Government of Zhejiang Province on Building a High level Civil Aviation Strong Province and Creating a Low altitude Economic Development Highland" (Zhe Zheng Fa [2024] No. 20), and closely focus on the goal of "building a high-level civil aviation strong province and creating a low altitude economic development highland", the following policy measures are formulated to further strengthen the guarantee of natural resource elements. This notice shall come into effect on November 11, 2024 and shall be valid for two years.
14. Guidelines for Compliance of Inspection and Testing Activities by Inspection and Testing Institutions in Shanxi Province (DB14/T 3037-2024)
This document provides the basic principles, organization and operation, compliance risk management, and evaluation improvement for inspection and testing institutions to carry out inspection and testing activities in compliance. This document is applicable to the compliance of inspection and testing institutions in carrying out inspection and testing activities. This standard shall come into effect on November 13, 2024.
15. Action Plan for Continuous Improvement of Air Quality in Hangzhou City
In order to continue to deepen the battle to protect the blue sky, effectively safeguard the health of the people, and promote high-quality economic and social development through continuous improvement of air quality, in accordance with the relevant requirements of the "Notice of the Zhejiang Provincial People's Government on Issuing the Action Plan for Continuous Improvement of Air Quality in Zhejiang Province" (Zhe Zheng Fa [2024] No. 11), and combined with the actual work of our city, this action plan is formulated. This action plan will be implemented from November 16, 2024, and will be led and organized by the Municipal Ecological Environment Bureau.
16. Management Measures for Foundation Pit Engineering in Shanghai
In order to strengthen the quality and safety management of foundation pit engineering in this city, ensure the safety of foundation pit engineering, the surrounding environment of foundation pits, and urban operation, based on relevant laws, regulations, rules, and technical standards, and combined with the actual situation of this city, this method is formulated. In the administrative area of this city, this method applies to the preliminary preparation, survey, design, scheme demonstration, construction drawing review, construction, supervision, testing, monitoring and other related activities of foundation pit engineering. This method is valid from November 18, 2024 to June 30, 2029.
17. Management Measures for Safety Production Training Institutions in Jiangxi Province (Trial)
In order to standardize the management of safety production training institutions in Jiangxi Province, promote the healthy and orderly development of the safety production training market, and comprehensively improve the quality of safety production training, this method is formulated in accordance with the "Safety Production Law of the People's Republic of China", "Safety Production Training Management Measures", "Regulations on Safety Technology Training and Assessment Management of Special Operation Personnel", "Basic Conditions for Safety Production Training Institutions" (AQ 8011-2023) and other regulations, combined with the actual situation in Jiangxi Province. These measures shall come into effect on November 20, 2024. If laws, regulations, and rules have other provisions, they shall prevail.
18. Pilot Plan for Deepening Environmental Credit Evaluation Supervision of Environmental Impact Assessment Institutions and Their Employees in Hangzhou City
According to the provisions of the "Hangzhou Social Credit Regulations" and the "Hangzhou Optimizing Business Environment Regulations", as well as the "Notice of the Hangzhou Municipal Committee of the Communist Party of China's Comprehensive Deepening Reform Commission Office and the Hangzhou Market Supervision Bureau on Issuing the Work Plan for Strong Governance and Excellent Services Reform of Third Party Institutions Involving Enterprises in Hangzhou" (Hang Shi Guan [2024] No. 48) and other requirements, after research, it has been decided to issue this plan. This plan will be implemented from November 21, 2024 and will be valid until December 31, 2025.
