Washington State in the United States restricts lead content in aluminum or brass cookware and tableware

The state of Washington in the United States limits the lead content in aluminum or brass cookware, tableware, and cookware components, which will take effect on January 1, 2026.
Recently, the Governor of Washington State signed SB 5628, which sets new limits on lead content in aluminum or brass cookware, tableware, and cookware components. This regulation will officially come into effect on January 1, 2026.

Main content of SB 5628 regulation
01. Limit on lead or lead compound content
Starting from January 1, 2026, aluminum or brass cookware, tableware, and cookware components with lead or lead compound content exceeding the following limits shall not be manufactured, sold, offered for sale, or distributed for sale in this state:
Starting from January 1, 2026, the limit is 90ppm
Starting from January 1, 2028, the limit is 10ppm
Starting from December 2030, after consultation with the health department, the department can lower the limit of 10ppm through regulations, provided that it is feasible for manufacturers of cookware and cookware components.
02. Add relevant definitions
Aluminum or brass cookware "refers to the following items made of brass or aluminum: pots, pans, kettles, round iron pans, grills, rice cookers or pressure cookers, and similar containers or surfaces used for cooking food.
Aluminum or brass cookware "does not include: a. items with only one layer of aluminum or brass inside but completely wrapped in stainless steel; Or b. The main body of electronic cooking devices with detachable cooking containers, such as slow cookers, rice cookers, and pressure cookers.
Aluminum or brass utensil "refers to tools made of aluminum or brass, such as knives, forks, spoons, shovels, and similar tools used for preparing, holding, or consuming food, unless these tools are completely wrapped in stainless steel.
Aluminum or brass cookware component "refers to cookware components made of aluminum or brass, such as lids, rivets, fasteners, valves, and ventilation pipes.
03. Exemption Status
Retailers or wholesalers who sell products with excessive lead content without knowledge will not be held responsible under this regulation. In addition, the sale or purchase of lead containing second-hand aluminum or brass cookware, tableware, and cookware components conducted by non-profit organizations or occasional transactions are exempt from the provisions of this regulation.
