UK solicits comments on proposed regulations on persistent organic pollutants

On March 2, 2023, the UK Department of Environment, Food and Rural Affairs (DEFRA) held consultations on its proposed regulations on persistent organic pollutants. The proposed amendments are related to changes to the Stockholm Convention, and the United Kingdom, as a party to the Convention, must implement them. Other proposed changes include a review of persistent organic pollutants regulations and a response to scientific or technological progress.

The proposed amendment to Annex 1 of the persistent organic pollutants regulations contains several important changes:

Cancel existing specific exemptions for four persistent organic pollutants: perfluorooctanoic acid (PFOA) and its salts and related compounds, perfluorooctane sulfonic acid and its derivatives (PFOS), short chain chlorinated paraffins, and decabromodiphenyl ether;

Added Unintentional Trace Pollutants (UTC) exemptions for at least two persistent organic pollutants (hexachlorobenzene and pentachlorophenol);

Delete and/or amend UTC's existing exemption for perfluorooctane sulfonate.

The deadline for review is April 27, 2023.
