Japan implements new requirements for the export of perfluorooctanoic acid and decabromodiphenyl ether

The Ministry of Economy, Trade and Industry (METI) of Japan has partially revised the Export Trade Control Order, and added the control requirements for perfluorooctanoic acid (PFOA) and its salts and decabromodiphenyl ether in Schedule I "Export Approval of Chemical Substances", which will be formally implemented on October 21, 2022.

New chemicals include:

  • Decabromodiphenyl ether, CAS No. 1163-19-5
  • Perfluorooctanoic acid, CAS No. 335-67-1
  • Salt of perfluorooctane sulfonic acid, CAS No. 3825-26-1, 335-95-5, 2395-00-8
  • Perfluorooctane sulfonic acid and related compounds

 

PFOA and decabromodiphenyl ether are persistent organic pollutants (POPs). According to the Export Trade Control Order, enterprises must obtain the permission of METI to export these substances and comply with the export restrictions of the Rotterdam Convention, such as the Prior Informed Consent (PIC) regulations. The manufacture, use, import and export of Japanese POPs are restricted by the Chemical Examination Law (CSCL) and the Export Trade Control Order. In July this year, METI planned to ban the import, production and use of 56 PFOA related compounds. The relevant regulations, the Implementation Order of the Chemical Examination Law, have yet to be issued.

 

PFOA and its salts and PFOA derivatives are widely used in light textile and chemical industries. The implementation of Japan's new regulations will have an impact on China's exports of textiles and clothing, paper products, leather products, plastic products and even electronic and electrical products. At the same time, the costs of production process improvement, equipment upgrading, auxiliary agent replacement, inspection and testing will increase significantly, and small and medium-sized enterprises with relatively backward processes will be greatly affected.
