Proposed restrictions
It is proposed to prohibit the production, use, and placing on the market of PFASs substances, as well as the placing on the market of substances, mixtures, and articles with PFASs content equal to or exceeding the following limits:
The measured content of any PFAS is equal to or exceeds 25 ppb (0.025 mg/kg) (excluding PFASs polymers), or
The total measured content of all PFASs is equal to or greater than 250 ppb (0.25 mg/kg) (excluding PFASs polymers) (optionally pre degrading the precursor), or
The total content of all PFASs is equal to or greater than 50 ppm (50 mg/kg) (counted as PFASs polymers).
If the total fluorine (F) content exceeds 50 mg/kg, the manufacturer, importer, or downstream user must provide test documentation for the fluorine content from PFASs or non PFASs upon request by law enforcement.
Proposed Implementation Date
The restrictions are intended to be implemented 18 months after the legislation comes into force.
Exemptions
It is proposed to exempt PFASs from multiple specific industrial and professional uses.
Definition
Perfluorinated and polyfluoroalkyl substances (PFASs): Any substance that contains at least one perfluoromethyl (CF3 -) or methylene (- CF2 -) carbon atom (without any H/Cl/Br/I atoms attached thereto).
Substances that contain only the following structural units do not fall within the limit: CF3-X or X-CF2-X ', when X=- OR or - NRR', and X 'is methyl (- CH3), methylene (- CH2 -), aromatic group, carbonyl (- C (O) -), - OR' ', - SR' ', or - NR' 'R' '. Wherein R/R '/R' '/R' 'is hydrogen (- H), methyl (- CH3), methylene (- CH2 -), aromatic group, or carbonyl (- C (O) -).
Public consultation on the proposed restrictions will last for six months until September 25, 2023. The Risk Assessment Committee (RAC) and the Socioeconomic Assessment Committee (SEAC) of the European Chemical Administration (ECHA) will conduct reviews. ECHA will submit the joint opinions of the two committees to the European Commission, which and EU member states will ultimately decide whether to add the proposed restricted items to the Annex XVII List of Restricted Substances of the REACH Regulation.
