2. Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Ecological Environment Tort Liability Disputes

In order to correctly hear cases of ecological environment infringement liability disputes, protect the legitimate rights and interests of the parties in accordance with the law, further improve the system of legal application rules for ecological environment trials, and promote the high-quality development of ecological environment trials, this interpretation is formulated in accordance with the provisions of the Civil Code of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the Environmental Protection Law of the People's Republic of China, and other laws, combined with trial practice. The Interpretation has a total of 29 articles, mainly stipulating the scope of ecological environment infringement cases, principles of liability attribution, multiple person infringement, responsible parties, responsibility bearing, and statute of limitations. This interpretation shall come into effect from September 1, 2023.

 

3. Decision on Abolishing and Amending Some Regulations, Administrative Normative Documents, and General Policy Documents

In order to deeply implement the spirit of the 20th National Congress of the Communist Party of China and improve the level of institutional construction of the National Development and Reform Commission, the National Development and Reform Commission has organized the cleaning up of regulations, administrative normative documents, and general policy documents. 4. Law of the People's Republic of China on the Ecological Protection of the Qinghai Tibet Plateau

In order to strengthen the ecological protection of the Qinghai Tibet Plateau, prevent and control ecological risks, ensure ecological security, build a national ecological civilization highland, promote sustainable economic and social development, and achieve harmonious coexistence between humans and nature, this law is formulated. This Law shall apply to activities related to the ecological protection of the Qinghai Tibet Plateau that are engaged in or involved in; If there are no provisions in this Law, the provisions of other relevant laws shall apply. The Qinghai Tibet Plateau referred to in this Law refers to all administrative regions of Tibet Autonomous Region and Qinghai Province, as well as relevant county-level administrative regions of Xinjiang Uygur Autonomous Region, Sichuan Province, Gansu Province, and Yunnan Province. This law shall come into effect on September 1, 2023.

This Catalogue will be implemented from September 1, 2023.

The management of urban appearance and environmental sanitation implements a system of subject responsibility, adhering to the principle of combining government leadership with social participation, and combining punishment with education. This regulation shall come into effect on September 1, 2023.

 

7. Changzhou City Construction Waste Management Measures

In order to strengthen the management of hazardous waste, prevent and control environmental pollution caused by hazardous waste, maintain ecological environment safety, and ensure the physical health of citizens, in accordance with laws and regulations such as the "Law of the People's Republic of China on the Prevention and Control of Solid Waste Pollution Environment" and the "Regulations of Yunnan Province on the Prevention and Control of Solid Waste Pollution Environment", and in combination with the actual situation of this city, this method is formulated. The prevention and control of environmental pollution caused by hazardous waste within the administrative area of this city, as well as its supervision and management, shall be governed by these measures. If there are other provisions in laws, regulations, and rules regarding the prevention and control of pollution from medical waste and radioactive waste, such provisions shall prevail. This measure shall come into effect from September 1, 2023.

11. List of Construction Projects Responsible for Approving Environmental Impact Assessment Documents by the Ecological and Environmental Supervision Department of Zhejiang Province (2023 Edition)

Except for the projects approved by the Ministry of Ecology and Environment and the projects listed in this list, all other projects shall be approved by the ecological and environmental authorities of the designated cities. The ecological environment regulatory department of a district or city should reasonably determine the project scope for the specific approval work of the county (city, district) ecological environment branch based on its carrying capacity. Refined petroleum product manufacturing, coal processing, biomass fuel processing, chemical fiber manufacturing, pesticide raw materials, organic synthetic dyes, and chemical raw material drug manufacturing projects located in various types of parks at or above the provincial level that have undergone planning and environmental impact assessments in accordance with the law, which require the preparation of environmental impact reports, shall be handled by the ecological environment regulatory department of the designated city at the same level. This notice shall come into effect from September 9, 2023.

 

12. Reform Plan for Environmental Impact Assessment System of Laboratory Level Production and Related Industries in the Biopharmaceutical Industry of Hangzhou City

16. Shanxi Province landmark "Technical Specification for Surface Flow Artificial Wetland Treatment of Coal Mine Wastewater Engineering" (DB14/T 2769-2023)

This document specifies the construction principles, design processes, construction, monitoring and management of surface flow artificial wetlands for the treatment of coal mine wastewater, and is applicable to the construction of surface flow artificial wetlands for the treatment of coal mine wastewater. Document drafting unit: Shanxi Forestry and Grassland Science Research Institute. The document states that the process design should be determined based on factors such as water quantity, water quality, floor area, emission requirements, engineering investment, as well as geographical and climatic conditions, vegetation types, etc. This standard will be implemented from September 21, 2023.

 

17. Shanxi Province Landmark "Technical Regulations for Restoration and Control of Sandy Land" (DB 14/T 2771-2023)

This document specifies the requirements for the classification and grading of desertification land, governance measures, nurturing and management, and file management, which are applicable to the restoration and management of desertification land, but not to desertification cultivated land. Document drafting unit: Shanxi Provincial Forestry and Grassland Engineering Station. Classification and grading of sandy land → diversion of sandy land into movable, semi fixed, and fixed sandy land; There are four levels of desertification: mild, moderate, severe, and extremely severe. This standard will be implemented from September 21, 2023.

 

18. Shanxi Province Landmark "Technical Regulations for Composting Treatment of Greening Waste" (DB 14/T 2774-2023)

This document specifies the basic requirements, treatment methods, maturity determination, and file management for the composting method for treating green waste, which is applicable to green waste composting. Document drafting units: Taiyuan Garden Quality Plant Protection Station and Taiyuan Kangpei Garden Greening Engineering Co., Ltd. The processing methods include raw material sorting, crushing, mixing, and ripening. The document specifies that green waste is generally crushed twice, and the particle size after crushing should be less than 1 cm. The carbon nitrogen ratio in the mixture should be controlled between 20:1 and 40:1, and the water content should be controlled between 40% and 65%. During the ripening process, flipping is necessary, and the flipping requirements vary depending on the composting period and the temperature changes inside the pile. This standard will be implemented from September 21, 2023.
