35 new hazardous chemicals added to the EU REACH Prior Informed Consent Regulation

The EU REACH "Prior Informed Consent Regulation" adds 35 new hazardous chemicals, including 27 insecticides and 8 industrial chemicals. The new regulations will come into effect from November 1, 2023.

On August 25, 2023, the European Commission issued Regulation (EU) 2023/1656, announcing revisions to the Prior Informed Consent Regulation (EU No 649/2012), adding 35 chemicals to Annex I, including 27 insecticides and 8 industrial chemicals. The new regulations will come into effect from November 1, 2023. Attachment I currently contains a total of 295 entries.

Understand PIC

The EU's Prior Informed Consent Regulation (PIC) regulates the import and export trade of certain hazardous chemicals that are strictly restricted or prohibited from being used within the EU, imposing obligations on companies planning to export these chemicals to non EU countries or import them into the EU. PIC is a compliance measure implemented by the European Union under the Rotterdam Convention, which promotes shared responsibility and cooperation in international hazardous chemical trade. At the same time, protecting human health and the environment by providing importing countries with information on how to safely store, transport, use, and dispose of hazardous chemicals. The PIC regulations came into effect on March 1, 2014.

Annex I of the PIC regulations includes prohibited or severely restricted chemicals:

-Active substances in biocides such as pesticides, disinfectants, or insecticides;
-Industrial Chemicals
-Chemicals prohibited from exporting from the European Union as listed in Annex V of the PIC Regulation

Notify export and obtain export license
Companies planning to export PIC listed chemicals to non EU countries need to inform them of their export intentions in advance and obtain an export license before exporting.

Notification obligation
Every year, importers and exporters of PIC chemicals are required to provide designated national institutions with accurate information on the quantity of the chemical transported to or from non EU countries in the previous year.
