California 65 Short Format Warning Label Revision Form Released

California OEHHA has revised California Regulation 65, which requires new labels to take effect by 2025 but with a three-year buffer period. Warning labels must contain at least one chemical name, and there are more options for signal words. The updated short format warning label will be mandatory in 2028, with approximately 8-14 words and a minimum font size of 6.

On December 6, 2024, the California Office of Environmental Health Hazard Assessment (OEHHA) released the revised text of California Code 65 on its official website, revising sections 25601, 25602, 25603, and 25607.2 of Title 27 of the California Code of Regulations and adding new sections 25607.50 to 25607.53. The new label requirement will take effect on January 1, 2025, but there is a three-year buffer period, meaning that products manufactured and labeled before January 1, 2028 can continue to use the old label.

1、 Main content update

A brief warning requires at least one chemical name to make California's short form warning label more informative to consumers. The new short format warning can be used immediately after the regulation is passed.

There are more options for warning and short warning signal words to choose from, which can start with the previously common word "Warning" or other words, such as "CA Warning" or "CALIFORNIA Warning".

For products purchased online before January 1, 2028, retailers have a 60 day transition period to update their online brief warnings upon receiving notification from the manufacturer. All changes should be completed within a 3-year transition period.

Develop clear safe harbor status for short format warning content on food.

Provide new customized safe harbor warnings for components of buses or non highway motor vehicles, as well as leisure vessel components.

2、 Updated Short Format Warning Label Template

The updated short format warning label will be mandatory from January 1, 2028, containing approximately 8-14 words, and the font size of point 6 (6-point type) remains the minimum font size for warning labels. The template for the new short format warning label (taking carcinogenic exposure risk as an example) is as follows:

Products produced and labeled before January 1, 2028, regardless of when they are sold to consumers, can continue to use the current short format warning labels or can be used immediately after regulations are passed.
