EU POPs releases revised regulation on perfluorooctanoic acid (PFOA), effective from August 3, 2025

On July 14, 2025, the European Union POPs issued a revised regulation (EU) 2025/1399 on perfluorooctanoic acid (PFOA), its salts, and related compounds, which will come into effect on August 3, 2025.

The main control limit requirements for PFOA, its salts, and related substances have not changed. For substances, mixtures, and articles, the content of PFOA and its salts is less than or equal to 0.025mg/kg, and the individual and total content of PFOA related substances is less than or equal to 1mg/kg.

Revised content of PFOA control requirements
The revision of the entry "Perfluorooctanoic acid (PFOA), its salts, and related compounds" in Part A of Appendix I of the POPs regulations is as follows:
- Revise point 3: Delete the second sentence "This exemption shall be reviewed and evaluated by the committee no later than August 25, 2023.
- Add a new point 4a: For the purpose of this entry, the exemption in paragraph (1) (b) of Article 4 shall apply to the PFOA and its salt that exist in the fire fighting foam for liquid fuel vapor fire extinguishing and liquid fuel fire extinguishing (Class B fire) that has been installed in the system, and the PFOA and its salt are less than or equal to 1mg/kg (0.0001% weight ratio), and the single or total PFOA related substances are less than or equal to 10 mg/kg (0001% weight ratio). This limit is valid until August 3, 2028.
- Add a new point 4b: For the purpose of this entry, the exemption in point (b) of paragraph (1) of Article 4 applies to the concentration of PFOA and its salts and PFOA related substances that are present in the non fluorine fire fighting foam and come from the fire fighting equipment cleaned according to the best available technology, the sum of which is less than or equal to 10 mg/kg (0001% by weight).
- Revise point 6: Replace the date "July 4, 2025" with "December 3, 2025"; Add the definition of "fire foam" at the end.
- Revise point 10: Delete the second sentence "The committee shall review and evaluate this exemption no later than February 22, 2023.
- Add a new point 11: Articles containing PFOA, salts, and PFOA related substances that have already been used in the European Union before the expiration date of the relevant exemptions specified in points 5 (a) to (d) may continue to be used.
