The Ministry of Ecology and Environment issued the Measures for the Administration of the Directory of Key Environmental Supervision Units, which further clarified the determination and issuance of the directory of key pollutant discharge units and will be implemented on January 1, 2023.

On December 1, the Ministry of Ecology and Environment issued the Measures for the Administration of the Directory of Key Environmental Supervision Units (Decree No. 27 of the Ministry), which further clarified the determination and issuance of the directory of key pollutant discharging units. The Measures will come into force on January 1, 2023. Which units should be listed as key pollutant discharge units? What are the responsibilities of the provincial and municipal ecological environment authorities?

 

01 Key pollutant discharge unit of water environment

Those who meet one of the following conditions shall be listed as key pollutant discharging units for water environment:
(1) Industrial enterprises whose annual discharge of any one of the water pollutants, including chemical oxygen demand, ammonia nitrogen, total nitrogen and total phosphorus, is greater than the screening discharge limit set by the municipal ecological environment department with districts in recent three years;
(2) Large scale livestock and poultry farms with sewage discharge outlets;
(3) Centralized industrial wastewater treatment plants and urban domestic sewage treatment plants with a daily treatment capacity of more than 100000 tons or more than 20000 tons of industrial wastewater.

The competent department of ecological environment at the level of a city divided into districts shall set the emission limit for screening, and shall ensure that the sum of the industrial water pollutants discharged by the selected key pollutant discharging units of the water environment is not less than 65% of the total industrial water pollutants discharged from the statistical investigation of the discharge sources of the administrative region.

 

02 Key pollutant discharge units for groundwater pollution control

Those who meet one of the following conditions shall be listed as key pollutant discharging units for prevention and control of groundwater pollution:
(1) Enterprises and institutions located in key areas for prevention and control of groundwater pollution and equipped with water pollutant discharge outlets;
(2) The operation and management units of the tailings pond under the primary and secondary environmental supervision and management;
(3) Operation and management units of hazardous waste disposal sites involving landfill disposal;
(4) Operation and management unit of domestic waste landfill with a daily treatment capacity of more than 500 tons.

 

03 Key pollutant discharge units of atmospheric environment

Those who meet one of the following conditions shall be listed as key pollutant discharging units for atmospheric environment:
(1) Industrial enterprises whose annual emissions of any one of the air pollutants, such as sulfur dioxide, nitrogen oxides, particulate matter and volatile organic compounds, are greater than the screening emission limits set by the municipal ecological environment authorities with districts in recent three years;
(2) Enterprises in the solar photovoltaic glass industry, and enterprises above designated size that use natural gas as fuel in other glass manufacturing, glass products, and glass fiber industries;
(3) Enterprises in the ceramic and refractory industries using coal, petroleum coke, oil and producer gas as fuel;
(4) Enterprises above designated size that use natural gas as fuel in ceramic and refractory industries;
(5) Enterprises above the designated size in the industrial coating industry, except for those who use water-based, solvent-free, radiation curing, powder and other low volatile organic content coatings in line with national regulations;
(6) Enterprises above the designated size in the packaging and printing industry, except those that use low volatile organic content inks in line with national regulations.

The competent department of ecological environment at the level of a city divided into districts shall set the emission limits for screening, and shall ensure that the sum of the industrial atmospheric pollutants discharged by the selected key pollutant discharging units of the atmospheric environment is not less than 65% of the total industrial atmospheric pollutants discharged by the statistical investigation of the emission sources of the administrative region.

 

04 Key noise emission units
An industrial enterprise that meets one of the following conditions shall be listed as a major noise emitting unit:
(1) Located in the area where noise sensitive buildings are concentrated or within 200m outside the factory boundary, where noise sensitive buildings are concentrated and cause noise pollution;
(2) Affecting the completion of the objectives set in the sound environment quality improvement plan in the administrative region;
(3) The problem of noise pollution is prominent and the people have a strong response.

 

05 Key supervision unit of soil pollution
Those who meet one of the following conditions shall be listed as key supervision units for soil pollution:
(1) Enterprises above designated size in nonferrous metal mining and beneficiation, nonferrous metal smelting, petroleum mining, petroleum processing, chemical industry, coking, electroplating and tanning industries;
(2) Enterprises located on land plots with high potential risk of soil pollution and producing, using, storing, disposing or discharging toxic and harmful substances;
(3) Cadmium related enterprises located in areas with prominent heavy metal pollution in cultivated land.

 

06 Key Environmental Risk Control Unit
Those who meet one of the following conditions can be listed as key environmental risk control units:
(1) Enterprises that produce more than 100 tons of hazardous waste annually;
(2) Enterprises with facilities for self utilization and disposal of hazardous waste;
(3) Enterprises holding hazardous waste operation licenses;
(4) Operation and maintenance units of domestic waste landfills (including closed sites) or domestic waste incineration plants;
(5) Enterprises whose uranium (thorium) content in raw ore, intermediate products, tailings (dregs) or other residues exceeds 1Bq/g in the development and utilization of mineral resources (except uranium and thorium ores).

 

07 What are the responsibilities of the provincial and municipal departments in charge of ecological environment?
The provincial competent department of ecological environment shall be responsible for coordinating and supervising the determination and release of the directory of key environmental supervision units in their respective administrative regions.

The ecological environment competent department of a city divided into districts shall be responsible for the determination, management and release of the directory of key environmental supervision units in its administrative region.

Enterprises and institutions that are required to implement the key management of pollution discharge permits as specified in the Catalogue of Classified Management of Pollution Discharge Permits for Fixed Pollution Sources (2019 Edition) as "included in the list of key pollution discharge units", and no longer meet the screening conditions for key pollution discharge units in accordance with the Measures, the municipal ecological environment authorities with districts shall make timely adjustments.

The municipal competent department of ecological environment divided into districts may, according to the environmental quality status of their respective administrative regions, the requirements for environmental quality improvement, the discharge of pollutants, toxic and harmful substances, and the requirements for environmental risk management and control, list the enterprises and institutions that really need to implement key supervision into the list of key environmental supervision units.

The municipal competent department of ecological environment with districts shall, before the end of January each year, draw up a preliminary directory of key environmental supervision units of this year and upload it to the directory information platform of key environmental supervision units.
The competent department of ecological environment at or above the provincial level may, by the end of February of each year, put forward suggestions on the adjustment of the preliminary list of key environmental supervision units through the information platform of the list of key environmental supervision units.

The municipal ecological environment authorities with districts can adjust the preliminary list of key environmental supervision units of this year according to the adjustment suggestions put forward by the ecological environment authorities at or above the provincial level, and determine the list of key environmental supervision units of this year before the end of March, and publish it to the public according to law.
