Netherlands revises migration limits for lead and cadmium in food contact ceramic products

The Netherlands has released amendments to the Packaging and Consumer Goods Act regarding food contact with ceramic products, significantly tightening the migration limits for lead and cadmium, which will take effect on May 29, 2026.
On May 4, 2026, the Dutch Ministry of Health, Welfare and Sports approved the publication of a revised version of the Packaging and Consumer Goods Act Regulations regarding food contact ceramic products. The regulation came into effect on May 29, 2026.

Main revised content
The main revised content of Chapter 6 in Annex A of the Regulations is summarized as follows:
The original Article 1 has been replaced, and the migration limits for lead and cadmium specified in Article 1.2.1 have been significantly tightened.

| *If ceramic products consist of containers with ceramic lids, the specific migration limits for lead and cadmium only apply to that container *If the specific migration limits for lead and cadmium in ceramic products do not exceed 50%, and at least three other products with the same shape, size, decoration, and glaze are tested in accordance with Annex I and II of Directive 84/500/EEC, and the average amount of lead and/or cadmium extracted from these products does not exceed the specified limits, and any of these products does not exceed 50% of these limits, then the product shall be deemed to comply with the requirements of this Regulation | ||
As stated in Article 1.2.4, operators may calculate or estimate the migration of lead and cadmium based on the composition of raw materials, supplier documents, or batch testing data of similar materials.
3. As stated in section 1.2.5, if the estimation mentioned in section 1.2.4 fails to provide sufficient accuracy, laboratory testing methods specified in Directive 84/500/EEC must be used to verify whether the product meets the new limit requirements.

Transition Period
The new regulations will come into effect on May 29, 2026. Food contact ceramic products that comply with the provisions of the Goods Law (Packaging and Consumer Goods Regulations) of May 28, 2026 and are first placed on the market before December 1, 2026, may continue to be sold on the market until inventory is sold out.
