Japan plans to investigate and clean up the list of existing food additives

The Ministry of Health, Labour and Welfare of Japan issued Notice No. 2 of 2023 on the sales of existing additives to prepare a list of additives to be cancelled.

On June 20, 2023, the Ministry of Health, Labour and Welfare of Japan issued Notice No. 2 of 2023 on the sales of existing additives to prepare a list of additives to be cancelled. The main contents of the notice include:

1. Conduct an investigation on the sales of existing additives. In accordance with the provisions of Article 2-3 of the Supplementary Provisions on the Partial Revision of the Food Hygiene Law and the Nutrition Kaizen (Law No. 101 of 1995) (hereinafter referred to as the "exemption provisions"), the Minister of the Ministry of Health, Labor and Welfare of Japan has formulated a list of additives to be exempted. The Ministry of Health, Labor and Welfare of Japan can prepare and publicly notify the list of additives to be eliminated in accordance with the provisions of the Elimination and Deletion Ordinance (hereinafter referred to as the "Elimination and Deletion Ordinance"), And after necessary procedures, remove its name from the existing list of additives (Ministry of Health and Welfare Notice No. 120, 1996). On this basis, 132 projects have been deleted so far. Due to the possibility that 78 of the existing additives listed in Annex 1 are not currently available for sale, the Ministry of Health, Labour and Welfare has decided to conduct a preliminary investigation into the actual sales conditions of the 357 existing additives on the existing additive list. This investigation is to investigate the actual sales and other situations of these items;

2. Notify the importers of existing additives to conduct an investigation. If there are any imports, please submit a report in accordance with the implementation guidelines in attachments 2-1 and 2-2. Existing additives or preparations that have not been reported in accordance with Annex 2-1 and 2-2, or food containing existing additives (hereinafter referred to as "existing additives") should not be sold;

3. A substance is an existing additive listed in Annex 1. If the substance is not used as a food additive, it is not a declared object in principle. However, if the substance is a vitamin or mineral intended to enhance food nutrition, even if not used as an additive, it must be declared;

4. According to the deletion regulations, additives removed from the existing additive list are prohibited from being sold as additives unless they are designated as additives again in accordance with Article 12 of the Food Hygiene Law (Law No. 223 of 1947).
