Starting from March 2024, a new batch of environmental laws and regulations, as well as environmental norms and standards, have been officially implemented. Come and take a look.

 

National documents and standards  

1. Decision of the State Council on Amending the Regulations on the Management of Substances that Deplete the Ozone Layer

The second article shall be revised as follows: "The term 'ozone depleting substances' referred to in these regulations refers to chemicals included in the' List of Controlled Ozone Depleting Substances in China '.' The 'List of Controlled Ozone Depleting Substances in China' shall be formulated, adjusted and published by the competent ecological and environmental department of the State Council in conjunction with relevant departments of the State Council." Article 4 is revised to read: "The management of ozone depleting substances shall adhere to the leadership of the CPC, and implement the Party's and the State's lines, guidelines, policies, decisions and arrangements. This Decision shall come into force as of March 1, 2024.

 

2. "Safety Requirements for Near Surface Disposal of Waste Radioactive Sources" (HJ 1336-2023)

To implement the Environmental Protection Law of the People's Republic of China, the Law on the Prevention and Control of Radioactive Pollution of the People's Republic of China, and the Nuclear Safety Law of the People's Republic of China, and to standardize the near surface disposal of waste radioactive sources, this standard is formulated. This standard specifies the safety requirements for the disposal of waste radioactive sources at near surface disposal sites, including basic requirements, requirements for the characteristics of near surface disposal waste radioactive sources, requirements for the preparation of waste radioactive sources, safety requirements for waste radioactive source waste packages, requirements for the disposal of waste radioactive source waste packages, and quality assurance requirements. This standard will be implemented from March 1, 2024.

 

3. Technical Specification for Acceptance of Environmental Protection Facilities upon Completion of Construction Projects - Uranium Mining and Metallurgy (HJ 1347.1-2024)

In order to implement the Environmental Protection Law of the People's Republic of China, the Environmental Impact Assessment Law of the People's Republic of China, the Radioactive Pollution Prevention and Control Law of the People's Republic of China, and the Regulations on Environmental Protection Management of Construction Projects, guide and standardize the acceptance work of environmental protection facilities for uranium mining and metallurgical construction projects, this standard is formulated. This standard specifies the work procedures and overall requirements for the acceptance of environmental protection facilities upon completion of uranium mining and metallurgical construction projects. This standard will be implemented from March 1, 2024.

 

4. Technical Specification for Acceptance of Environmental Protection Facilities upon Completion of Construction Projects - Decommissioning of Uranium Mining and Metallurgy (HJ 1347.2-2024)

In order to implement the Environmental Protection Law of the People's Republic of China, the Environmental Impact Assessment Law of the People's Republic of China, the Law of the People's Republic of China on the Prevention and Control of Radioactive Pollution, and the Regulations on the Management of Environmental Protection for Construction Projects, and to guide and standardize the acceptance work of environmental protection facilities for uranium mining and metallurgical decommissioning projects, this standard is formulated. This standard specifies the work procedures and overall requirements for the acceptance of environmental protection facilities upon completion of uranium mining and metallurgical decommissioning projects. This standard will be implemented from March 1, 2024.

 

5. Technical Specification for Acceptance of Environmental Protection Facilities upon Completion of Construction Projects - Satellite Earth Uplink Station (HJ 1348-2024)

In order to implement the Environmental Protection Law of the People's Republic of China, the Environmental Impact Assessment Law of the People's Republic of China, and the Regulations on the Management of Environmental Protection for Construction Projects, protect the environment, guide and regulate the acceptance work of environmental protection facilities after the completion of satellite earth uplink station construction projects, this standard is formulated. This standard specifies the work procedures and overall requirements for the acceptance of environmental protection facilities after the completion of satellite earth uplink station construction projects. This standard will be implemented from March 1, 2024.

 

6. "Methods for Regional Electromagnetic Environment Investigation and Evaluation (Trial)" (HJ 1349-2024)

To implement the Environmental Protection Law of the People's Republic of China, protect the environment and public health, prevent and control electromagnetic radiation pollution, and standardize the investigation and evaluation of regional electromagnetic environment, this standard is formulated. This standard specifies the technical requirements and content for the investigation and evaluation of electromagnetic environment in the frequency band of 0.1 MHz to 6 GHz. Appendix A and Appendix B of this standard are informative appendices, while Appendix C is normative appendices. This standard is first published. This standard will be implemented from March 1, 2024.

 

7. General Technical Regulations for Soil Passivation of Heavy Metal Pollution in Agricultural Product Production Areas (GB/T 42819-2023)

This document establishes the work procedure for passivation remediation of heavy metal contaminated soil in agricultural product production areas, specifies the feasibility assessment of passivation remediation technology application, passivation agent screening, formulation and implementation of remediation plans, describes remediation effect assessment, environmental monitoring plan, and sampling and analysis methods. This document applies to soil remediation in agricultural production areas that are contaminated with cadmium, arsenic, lead, chromium, copper, nickel, and zinc, which have adverse effects on crop growth or soil ecological environment. This document is not applicable to the remediation of soil in agricultural product production areas contaminated with mercury. This standard will be implemented from March 1, 2024.

 

8. "Evaluation Index System for Clean Production in Copper Smelting Industry"

This indicator system specifies the general requirements for clean production in copper smelting enterprises. This indicator system divides clean production evaluation indicators into nine categories, namely production process and equipment, energy consumption, water resource consumption, raw/auxiliary material consumption, comprehensive resource utilization, pollutant generation and emissions, greenhouse gas emissions, product characteristics, and clean production management. This indicator system is applicable to the clean production audit, assessment of clean production potential and opportunities, clean production performance evaluation, and clean production performance announcement system of copper smelting enterprises. It is also applicable to management systems such as environmental impact assessment, pollution discharge permits, and environmental protection leaders. This standard will be implemented from March 1, 2024.

 

9. "Evaluation Index System for Clean Production in Lead Smelting Industry"

This indicator system specifies the general requirements for clean production in lead smelting production enterprises. This indicator system divides clean production indicators into eight categories, namely production process and equipment, energy consumption, water resource consumption, comprehensive resource utilization, pollutant generation and emissions, greenhouse gas emissions, product characteristics, and clean production management. This indicator system is applicable to the clean production audit, assessment of clean production potential and opportunities, clean production performance evaluation, and clean production performance announcement system of lead smelting production enterprises. It is also applicable to management systems such as environmental impact assessment, pollution discharge permits, and environmental protection leaders. This standard will be implemented from March 1, 2024.

 

 

Local/group documents and standards   

 

1. Regulations on Promoting High Quality Development of Manufacturing Industry in Guangdong Province

On January 20th, the Standing Committee of the Guangdong Provincial People's Congress issued the "Regulations on Promoting High Quality Development of Manufacturing Industry in Guangdong Province", which pointed out that people's governments at or above the county level and relevant departments such as industry and information technology should deepen the implementation of green manufacturing projects, accelerate the green and low-carbon transformation of manufacturing industry, promote energy conservation and carbon reduction in key industries, and build green and low-carbon industrial parks. Encourage manufacturing enterprises to carry out research and promotion of advanced and applicable technologies such as low-carbon, zero carbon, and negative carbon, strengthen the recycling of industrial solid waste and renewable resources, and develop a green circular economy. Support manufacturing enterprises to use new energy and improve energy utilization efficiency. Promote the high-end, intelligent, green, integrated, and clustered development of the manufacturing industry. This regulation shall come into effect on March 1, 2024.  

 

2. Regulations on Rural Water Supply in Guangdong Province  

The Regulations on Rural Water Supply in Guangdong Province have been issued, which will be used for the planning, construction, operation, management, and supervision of rural water supply projects in Guangdong Province. It clarifies the principles of government leadership, social participation, adapting to local conditions, ensuring safety, and conserving water. Effective from March 1, 2024.

 

3. Guangzhou Green Building and Building Energy Conservation Management Regulations  

The Guangzhou Green Building and Building Energy Conservation Management Regulations were passed at the 57th Executive Meeting of the 16th Municipal People's Government on December 21, 2023, and will come into effect on March 1, 2024. The planning, construction, operation, renovation, building energy conservation, and supervision and management of green buildings within the administrative area of this city shall be governed by these regulations.  

 

4. Regulations on the Management of Urban Appearance and Environmental Hygiene in Yunfu City  

The Regulations on the Management of Urban Appearance and Environmental Hygiene in Yunfu City were passed at the 13th meeting of the Standing Committee of the 7th People's Congress of Yunfu City and approved at the 6th meeting of the Standing Committee of the 14th People's Congress of Guangdong Province on November 23, 2023. They will come into effect on March 1, 2024. This regulation applies to the urban built-up areas within the administrative area of this city, as well as other urban appearance and environmental sanitation management areas determined and announced by the people's governments of cities and counties (cities, districts) to implement urbanization management.

 

 

5. Jiangmen City Construction Waste Management Measures  

On January 29, 2024, the People's Government of Jiangmen City issued the "Jiangmen City Construction Waste Management Measures" (Jiangmen City Government Order No. 13), which will come into effect on March 1, 2024. The generation, collection, storage, transportation, utilization, disposal, and related supervision and management activities of construction waste within the administrative area of this city shall be governed by these measures.  

 

6. Management Measures for Urban Secondary Water Supply in Shantou City  

The Management Measures for Urban Secondary Water Supply in Shantou City were announced on December 29, 2023 by Order No. 210 of the Shantou Municipal People's Government, and are scheduled to come into effect on March 1, 2024. The secondary water supply management activities for residential buildings included in the public water supply service scope in the central urban area of Shantou City shall be subject to these measures. The secondary water supply facilities referred to in these Measures include pump rooms, water supply pipelines, water tanks (boxes), water pumps, valves, electrical control devices, disinfection equipment, measuring water meters, pressure water containers, automatic control and monitoring systems, and other related facilities set up for secondary water supply.

 

7. Assessment Standards for Carbon Emission Reduction of Urban Sewage Treatment Plants

 

The China Urban Water Supply and Drainage Association has released the group standard "Carbon Emission Reduction Assessment Standards for Urban Sewage Treatment Plants", which will be implemented from March 1, 2024.

 

8. "Approval Authority Division Plan for Setting up River Discharge Outlets in Shandong Province (Trial)"

According to the Notice of the General Office of the State Council on Fully Implementing the Management of the List of Administrative Licensing Matters (GBF [2022] No. 2) and the Announcement of the Ministry of Ecological Environment on Issuing the Implementation Standards for Administrative Licensing Matters in the Field of Ecological Environment (Announcement No. 7 in 2023), the approval of new construction, reconstruction or expansion of sewage outlets in rivers and lakes is included in the list of administrative licensing matters, and administrative licensing is implemented according to law and regulations. This plan will be implemented from March 1, 2024 and is valid until February 28, 2026.

 

9. Management Measures for Regional Limit Approval of Environmental Impact Assessment for Construction Projects of Sichuan Provincial

Department of Ecology and Environment In order to urge local people's governments to fulfill their ecological and environmental protection responsibilities, implement the requirements of ecological and environmental zoning control, promote the improvement of ecological and environmental quality, tilt environmental resources more towards regions, industries, and enterprises that meet the requirements of ecological and environmental protection and implement high-quality development, and support high-quality development with high water level protection, this method is formulated in accordance with laws and regulations such as the Environmental Protection Law of the People's Republic of China, the Water Pollution Prevention and Control Law of the People's Republic of China, the Air Pollution Prevention and Control Law of the People's Republic of China, as well as the provisions of the Administrative Measures for Regional Approval of Environmental Impact Assessment of Construction Projects (Trial) (Huan Fa [2015] No. 169) regarding the regional approval of environmental impact assessment of construction projects. This method will come into effect on March 15, 2024, and is valid for 5 years.

 

10. Management Measures for the Operation and Maintenance of Rural Domestic Sewage Treatment Facilities in Sichuan Province

In order to standardize and strengthen the operation and maintenance management of rural domestic sewage treatment facilities throughout the province, ensure the normal operation of treatment facilities, solidly promote rural construction actions, build livable, business friendly and beautiful rural areas, and promote rural ecological revitalization, in accordance with relevant laws, regulations, and document provisions, combined with practical work, this method is formulated. This method is applicable to the operation, maintenance, and supervision and management of rural domestic sewage treatment facilities within the administrative region of the province. The rural areas referred to in these Measures refer to regional complexes outside urban built-up areas that have natural, social, and economic characteristics, as well as multiple functions such as production, life, ecology, and culture. This method will come into effect on March 1, 2024, and is valid for five years.

 

11. Measures for the Automatic Monitoring and Management of Pollution Sources in Shanxi Province (Trial)

In order to strengthen the main responsibility of automatic monitoring of pollutant discharge units, establish and improve a non site law enforcement and supervision system mainly based on automatic monitoring of pollution sources, further standardize the construction and operation management of automatic monitoring systems for pollution sources throughout the province, and fully leverage the role of automatic monitoring systems for pollution sources in environmental management, in accordance with the Environmental Protection Law of the People's Republic of China and the Water Pollution Prevention and Control Law of the People's Republic of China This method is formulated in accordance with relevant laws and regulations such as the Air Pollution Prevention and Control Law of the People's Republic of China, the Regulations on the Administration of Pollutant Discharge Permits, the Measures for the Administration of Automatic Monitoring of Pollution Sources, and the Measures for the Supervision and Inspection of Automatic Monitoring Facilities of Pollution Sources, combined with the actual situation in Shanxi Province. This method will come into effect on March 1, 2024, and is valid for two years.

 

12. Regulations on the Prevention and Control of Soil Pollution in Zhejiang Province

In order to protect and improve the ecological environment, prevent and control soil pollution, safeguard public health, promote the sustainable use of soil resources, and build a beautiful Zhejiang at a high level, this regulation is formulated in accordance with laws and administrative regulations such as the Soil Pollution Prevention and Control Law of the People's Republic of China, combined with the actual situation of this province. This regulation applies to the prevention and control of soil pollution and related activities within the administrative region of this province. The prevention and control of soil pollution should adhere to the principles of prevention first, protection priority, classified management, collaborative governance, risk control, pollution responsibility, and public participation. This regulation shall come into effect on March 1, 2024.

 

13. Measures for the Automatic Monitoring and Management of Pollution Sources in Zhejiang Province (Trial)  

The Measures for Automatic Monitoring and Management of Pollution Sources in Zhejiang Province (Trial) are applicable to water and atmospheric pollution discharge units included in the list of key environmental supervision units within the administrative region of this province. Polluting units shall, in accordance with relevant national and provincial standards, specifications, and document requirements, install automatic monitoring equipment for pollutant emissions within the prescribed period and connect it to the monitoring platform of the ecological environment regulatory department. Acceptance shall be deemed as effective networking. The method will come into effect on March 1, 2024, and is valid for 2 years.

 

14. Several Regulations on the Construction and Operation Management of Urban Sewage Pipeline Networks in Hunan Province

The current construction land scope of urban areas (including cities and counties, as well as towns below the county level) within the administrative region of this province, as well as construction in other areas determined by the people's governments of cities (autonomous prefectures) and counties (cities, districts) with districts, shall implement rainwater and sewage diversion. The diversion of rainwater and sewage in towns and districts below the county level should be gradually implemented based on the population size, actual pollution discharge, and relevant national regulations. This regulation shall come into effect on March 1, 2024.

 

15. Interim Measures for the Administration of Carbon Emission Trading in Hubei Province

In order to standardize carbon emission trading activities, promote greenhouse gas emissions reduction, achieve carbon peak and carbon neutrality goals, and promote ecological civilization construction, this method is formulated in accordance with relevant laws, regulations, and other provisions, combined with the actual situation of this province. This method applies to carbon emission trading and related activities within the administrative region of this province, including carbon emission quota allocation and repayment, carbon emission registration, trading, settlement, greenhouse gas emission reporting and verification, as well as supervision and management of the aforementioned activities. Key emission units included in the national carbon emission trading management shall have their carbon emission trading management implemented in accordance with relevant national regulations. This method shall come into effect on March 1, 2024.

 

16. Henan Province Rural Water Supply Management Measures  

The Measures for the Administration of Rural Water Supply in Henan Province are applicable to rural water supply, use, and supervision and management activities within the administrative region of Henan Province. The method stipulates that people's governments at or above the county level shall include rural water supply in their national economic and social development plans, establish and improve a funding mechanism that is suitable for the level of economic and social development and the requirements of rural water supply development, ensure the necessary funds for the construction, operation, maintenance and management of rural water supply projects, and implement relevant preferential policies such as land use, electricity use, and taxation. The measures will be implemented from March 1, 2024.

 

17. Regulations on Green Development of Buildings in Beijing

The Regulations on Green Development of Buildings in Beijing were passed at the 6th meeting of the Standing Committee of the 16th People's Congress of Beijing on November 24, 2023, and will come into effect on March 1, 2024. The planning, construction, operation and maintenance, renovation and demolition activities of civil and industrial buildings within the administrative area of this city, as well as the green development and supervision and management of related industries, shall be governed by this regulation.

 

18. Regulations on the Construction and Management of Sponge Cities in Ordos City

In order to promote the construction of sponge cities, standardize sponge city management, conserve urban water resources, enhance urban flood prevention capabilities, and enhance urban ecosystem functions, in accordance with relevant laws and regulations such as the Urban and Rural Planning Law of the People's Republic of China and the Building Law of the People's Republic of China, and in combination with the actual situation of this city, this regulation is formulated. The planning, construction, operation, maintenance, supervision and management activities of sponge cities within the administrative area of this city shall be governed by this regulation. This regulation shall come into effect on March 1, 2024.
