FControl of UV-328, a new 31st substance added to POPs in the European Union

The EU POPs regulation has been officially revised to include UV-328 in Regulation (EU) 2025/843, bringing the total number of banned substances in the EU to 31.
On July 15, 2025, the Official Journal of the European Union released the officially revised Regulation (EU) 2025/843 on the addition of UV-328 to the EU POPs Regulation. It came into effect on August 4, 2025, the twentieth day after its publication in the Official Journal. As a result, the number of prohibited substances for POPs in the EU has been officially upgraded from 30 to 31.
The main control limit requirements for UV-328 are: the concentration of UV-328 in substances, mixtures, and articles should be ≤ 100mg/kg (August 4, 2025- August 3, 2027), ≤ 10mg/kg (August 4, 2027- August 3, 2029), and ≤ 1mg/kg (starting from August 4, 2029).

For the purpose of this article, point (b) of Article 4 (1) applies to substances, mixtures, or articles, (a) Starting from August 4, 2025, UV-328 concentration ≤ 100 mg/kg (0.01% weight ratio); (b) Starting from August 4, 2027, UV-328 concentration ≤ 10 mg/kg (0.001% weight ratio); (c) Starting from August 4, 2029, UV-328 concentration ≤ 1 mg/kg (0.0001% weight ratio); 2. As an exemption, the following items containing UV-328 are allowed to be placed on the market: (a) Land motor vehicles, until August 4, 2030; (b) Industrial coatings for land motor vehicles, engineering machinery, and rail transit vehicles, as well as heavy-duty coatings for large steel structures, until August 4, 2030; (c) Mechanical separator in the blood collection tube, until August 4, 2030; (d) Cellulose triacetate film in polarizer, until August 4, 2030; (e) Photographic paper, until August 4, 2030; (f) Civil and military aircraft, until August 4, 2030; (g) Spare parts for any of the following devices: (i) Land motor vehicles; (ii) Fixed industrial machinery used in agriculture, forestry, and construction; (iii) LCD displays used in instruments for non-medical analysis, measurement, control, monitoring, testing, production, and inspection; If UV-328 was originally used for the production of the above equipment, it can continue to be used until the end of its service life or December 31, 2043, whichever is earlier. (h) Spare parts for any of the following devices: (i) LCD displays in devices within the scope of Regulation (EU) 2017/745 and (EU) 2017/746; (ii) LCD displays used in instruments for analysis, measurement, control, testing, production, and inspection; If UV-328 was originally used for the production of the above equipment, it can continue to be used until the end of its service life; (i) If UV-328 was originally used to produce spare parts for civilian and military aircraft, it can continue to be used until December 31, 2030; 3. Articles containing UV-328 that have already been used in the European Union may continue to be used on or before the expiration of the relevant exemptions specified in paragraphs 2 (a) to (i). |
Regarding UV-328
UV-328 is a type of ultraviolet absorber widely used in industries such as plastics, coatings, rubber, adhesives, electronic appliances, etc. to improve the UV resistance of materials. Due to its persistence, bioaccumulation, and toxicity (PBT), as well as high persistence and high bioaccumulation (vPvB), UV-328 was identified as a highly concerned substance (SVHC) by the European Chemicals Agency (ECHA) in December 2014.
