◉ Introduction to Environmental Protection Acceptance
After the completion of a construction project, environmental protection acceptance shall be carried out in accordance with the relevant provisions of the "Interim Measures for Environmental Protection Acceptance of Construction Project Completion" (National Environmental Protection and Environmental Impact Assessment (2017) No. 4). After the completion of the project, the construction unit shall carry out environmental protection acceptance of the construction project completion. Only after passing the acceptance can the main project be put into production or use.
◉ Scope of Environmental Protection Acceptance
Construction projects that prepare environmental impact assessment reports (forms) should carry out independent environmental protection acceptance in accordance with the law; Construction projects that fill out the Environmental Impact Registration Form do not require independent environmental protection acceptance.
The scope of independent environmental protection acceptance is the environmental protection facilities and measures that are built to support the construction project. Environmental protection facilities refer to the devices, equipment, and engineering facilities required for preventing and controlling environmental pollution and ecological damage, as well as conducting environmental monitoring; Environmental protection measures refer to management or technological measures that prevent or mitigate adverse effects on the environment.
◉ Environmental Protection Acceptance Subject and Responsibility
(1) Acceptance subject
The construction unit is the responsible party for the environmental protection acceptance of the construction project, and should organize the acceptance of the environmental protection facilities supporting the construction project, prepare acceptance reports, disclose relevant information, and accept social supervision.
The acceptance report includes three items: acceptance monitoring (investigation) report, acceptance opinions, and other matters that need to be explained.
(2) Acceptance responsibility
The construction unit shall ensure that the environmental protection facilities required for the construction project are put into operation or used simultaneously with the main project, and shall be responsible for the authenticity, accuracy, and completeness of the acceptance content, conclusions, and publicly disclosed information, and shall not engage in fraud during the acceptance process.
If the construction unit does not have an environmental protection specialist (with environmental protection related professional titles) and does not have the ability to prepare acceptance monitoring (investigation) reports, it should entrust a capable technical institution to prepare them. The preparation personnel must have environmental protection related professional titles (such as ecological environment management and consulting, ecological environment monitoring, environmental protection, ecological environment engineering, etc.), and require personnel with intermediate or higher environmental protection professional titles to review and sign their names.
The construction unit is responsible for the conclusion of the acceptance monitoring (investigation) report prepared by the commissioned technical institution.
◉ Environmental acceptance deadline
The acceptance period refers to the time from the completion of the environmental protection facilities of the construction project to the date when the construction unit publicly releases the acceptance report to the society.
Except for water and air pollution prevention and control facilities that require a pollutant discharge permit, the acceptance period for other environmental protection facilities generally does not exceed 3 months; If it is necessary to debug or rectify such environmental protection facilities, the acceptance period can be appropriately extended, but not exceeding 12 months.
If the environmental protection facilities of the construction project are not built simultaneously with the main project or if a pollutant discharge permit should be obtained but not obtained, the environmental protection facilities should not be debugged.
For construction projects that are constructed in stages, put into production or use in stages, phased acceptance can be carried out in accordance with the law.
◉ Environmental acceptance procedures and content
(1) Preparation before acceptance
1. Review the environmental impact assessment documents and approval decisions from the approval department
Refer to the environmental impact assessment documents and approval decisions of the approval department, record the basic information of the construction project and environmental protection requirements.
The basic information of the construction project includes the project name, the type of environmental impact assessment document for the construction site, the environmental impact assessment approval number, the basic construction content, the nature of the construction, the production scale, and the main economic and technical indicators,
Environmental protection requirements include the construction of various pollution prevention and control facilities, ecological protection measures, emission standards for major pollution sources, environmental management requirements, etc. during the implementation of construction projects.
The construction project that prepares an environmental impact assessment report shall record the various environmental protection facilities required to be implemented in the environmental protection measures section of the report, the environmental quality standards and pollutant emission standards in the general section, and the "three simultaneities" acceptance content in the environmental management section; The construction project that prepares an environmental impact assessment report shall record the environmental protection facilities required to be implemented in the conclusion of the report, as well as the environmental quality standards and pollutant emission standards in the standard section; In other environmental impact reports related to construction projects, record newly proposed or updated environmental protection facilities, environmental quality standards, and pollutant emission standards; The environmental impact assessment approval or reply letter from the ecological environment department shall record the environmental protection facilities, environmental quality standards, pollutant emission standards, and environmental management requirements proposed in the documents.
Verify the contents of the pollutant discharge permit:
One is whether the completion status of the project is consistent with the content of the certificate, including the main production process, products and output, raw and auxiliary material consumption, project main works, auxiliary works, public works, storage and transportation works, and supporting engineering content and scale;
The second is whether the construction of pollutant treatment facilities is consistent with the content of the certificate, including pollution control technology, number of sewage outlets, types and quantities of pollutants discharged, etc;
The third is whether the requirements for pollutant emission standards are consistent with the permit requirements, including the name of the pollutant emission standard, the pollutant emission standard limit, and the total emission amount.
2. Collect construction project construction materials
Refer to planning documents, design documents, equipment lists, production processes, major economic and technical indicators, major raw and auxiliary materials, public works, environmental supervision and other materials, record the corresponding content in the environmental impact assessment documents and approval decisions of the approval department, including basic project information, pollution prevention and control facilities, ecological protection measures, risk prevention measures, etc. For those relying on other pollution control facilities (such as centralized treatment) for treatment, relevant contracts or agreements should be provided. For those entrusting non centralized treatment, relevant rights and responsibilities should be explained, such as who is responsible and who is punished in case of excessive emissions.
3. Organize and accept supporting documents
Collect acceptance support documents such as solid waste disposal contracts, drainage certificates, pollutant discharge permits, and relevant agreements.
4. Public completion and commissioning time
Except for situations where confidentiality is required by the state, the construction unit shall disclose the completion time and commissioning time of the construction project to the public through its website or other means that are easily known to the public.
After the completion of the environmental protection facilities supporting the construction project, the completion date shall be publicly announced; Before the commissioning of environmental protection facilities for supporting construction projects, the start and end dates of the commissioning shall be publicly announced.
(2) Carry out acceptance inspection
1. Check the construction content of the project
Pollution impact construction projects. Compare the environmental impact assessment documents and approval decisions of the approval department from the aspects of construction site, nature, content, scale, process and flow, product plan, raw and auxiliary materials, layout, public works, supporting facilities, etc., record the consistency of the approval and construction, determine the scope of acceptance, and judge whether the changes or additions to the construction project are significant changes.
Ecological impact construction projects. Compare the environmental impact assessment documents and approval decisions of the approval department from the aspects of construction site, nature, functional positioning, scale, route direction and form, main technical indicators, environmentally sensitive areas, supporting facilities, etc., record the consistency of the approval and construction, determine the acceptance scope, and judge whether the changes or additions to the construction project belong to significant changes.
2. Inspect the environmental protection facilities of the project
Pollution impact construction projects. Compare the environmental protection requirements for wastewater, exhaust gas, noise, vibration, solid waste, groundwater, soil, risk prevention, etc. in the environmental impact assessment documents and approval decisions of the approval department one by one, record the implementation of various environmental protection measures, with a focus on new pollution sources and corresponding pollution prevention and control facilities.
Ecological impact construction projects. Compare the environmental protection requirements for wastewater, exhaust gas, noise, vibration, solid waste, groundwater, soil, risk prevention, etc. in the environmental impact assessment documents and approval decisions of the approval department one by one, record various environmental protection measures, ecological protection or restoration projects, with a focus on adding environmentally sensitive targets and corresponding pollution prevention and control facilities.
3. Check other environmental protection measures
Standardization of sewage outlets. Whether the location and quantity of pollutant discharge outlets, the method and destination of pollutant discharge comply with the requirements of the pollutant discharge permit.
Online monitoring. Whether the construction project of installing an automatic monitoring system for fixed pollution source water pollutants and air pollutants emissions in accordance with relevant regulations has installed automatic monitoring equipment and connected to the ecological environment department, and conducted acceptance according to relevant technical specifications.
Sign identification. Whether the pollutant sampling ports, sampling platforms, and signs of the construction project are in accordance with the "Notice on Issuing Technical Specifications for Emission Port Signs" (Environmental Office [2003] No. 95), whether the labeling of hazardous waste storage sites is correct, and whether the location is reasonable.
Environmental risk prevention measures. According to the approved environmental impact assessment documents and the risk prevention measures requirements approved by the approval department, record the implementation of the device area cofferdam, anti-seepage engineering, accident pool, accident alarm system, groundwater monitoring well, emergency material reserve, etc.
Other measures. Refer to the environmental impact assessment documents and the approval decisions of the approval department regarding the "replacing old with new" project, clean production project, greening project, soil and water conservation project, ecological restoration project, etc., and record the specific implementation situation.
4. Determine whether significant changes have occurred
Discriminant principle: If one or more of the five factors of nature, scale, location, production process, and environmental protection measures of a construction project undergo significant changes during implementation, and may lead to significant changes in environmental impact (especially aggravated adverse environmental impact), it is defined as a significant change. At present, the Ministry of Ecology and Environment has released a list of major changes in pollution impact construction projects and a list of major changes in 28 industries. Construction projects not included in the list can be executed based on their location, scale, process, environmental protection facilities, main technical indicators, etc., and an analysis of the pollutant emissions and environmental impacts caused by changes can be conducted.
5. Acceptance monitoring
(1) Monitoring object: Pollutant emission monitoring refers to projects that have environmental protection facilities and emission standards requirements in environmental impact assessment documents and approval decisions of the approval department, as well as total control pollutant projects specified in the pollutant discharge permit; The monitoring of environmental protection facility treatment efficiency is a project that has clear requirements in the approval decision of the approval department; Environmental sensitive target monitoring refers to projects that have environmental protection facilities and environmental quality standards required for environmental sensitive targets in the environmental impact assessment documents and approval decisions of the approval department.
(2) Monitoring factors and standard implementation: Projects that obtain pollutant discharge permits can generally directly refer to the factors specified in the pollutant discharge permit.
(3) Monitoring standard implementation: Referring to the emission standards registered on the pollutant discharge permit, if the standards issued or revised after the approval of the environmental impact assessment document have clear time limit requirements for the implementation of the standards, they shall be implemented according to the newly issued or revised standards; In the acceptance stage, if the industry to which the construction project belongs releases new industry standards or local standards, the newly released standards shall be followed; The limit value of pollutant emission standards should not be lower than the requirements of environmental impact assessment documents and approvals.
(4) During the monitoring period, refer to the appendix of the "Technical Guidelines for Environmental Protection Acceptance of Construction Projects - Pollution Impact Category".
(5) Monitoring frequency: For construction projects with obvious production cycles and stable pollutant emissions, the sampling and monitoring frequency of pollutants is generally 2-3 cycles, with 3 to 3 times per cycle (not less than the number specified in the implementation standards).
For construction projects with no obvious production cycle, stable pollutant emissions, and continuous production, the frequency of waste gas sampling and monitoring is generally not less than 2 days, and not less than 3 samples per day; The frequency of wastewater sampling and monitoring is generally not less than 2 days, and not less than 4 times a day; Factory noise monitoring is generally not less than 2 days, with no less than 1 day and 1 night per day; Solid waste (liquid) sampling is generally not less than 2 days, with no less than 3 samples per day, and the mixed samples are analyzed daily.
The monitoring of environmental quality, surface water environmental quality monitoring is generally not less than 2 days, and the monitoring frequency is determined according to the monitoring technical specifications and combined with the wastewater discharge rules of the construction project discharge outlet; Groundwater monitoring is generally not less than 2 days and not less than 2 times a day, and the sampling method shall be carried out in accordance with technical specifications; Environmental air quality monitoring is generally not less than 2 days, and the sampling time is carried out according to standard specifications; The monitoring of environmental noise and vibration is generally not less than 2 days, and the monitoring quantity and time shall be carried out in accordance with standard specifications; At least three sampling points shall be set up for soil environmental quality monitoring, and at least one sample shall be collected from each sampling point. The layout of sampling points and the method of sample collection shall be carried out in accordance with technical specifications.
(6) Monitoring implementation organization: The acceptance monitoring sampling method, monitoring analysis method, monitoring quality assurance, and quality control requirements shall be implemented in accordance with the General Principles of Technical Guidelines for Self Monitoring of Pollutant Discharge Units (HJ819). If the construction unit establishes a monitoring quality system, it can conduct acceptance monitoring on its own. Otherwise, it should entrust other qualified inspection (monitoring) institutions to carry out acceptance monitoring on its behalf and confirm the qualifications of the inspection (monitoring) institutions.
6. Ecological Impact Investigation
Ecological impact investigation generally includes the impact on ecosystem structure and function, the impact on ecologically sensitive areas, and the impact on protected species. The principles of investigation factors are consistent with the ecological impact assessment factors in the environmental impact report (table), mainly including ecological function integrity, vegetation type, biomass, wildlife species, resource quantity, species diversity, land resources, soil erosion area, soil erosion intensity, ecologically sensitive areas, etc.
7. Investigation of Environmental Management System
Pollutant Discharge Permit. Construction projects included in the management of pollutant discharge permits should record the situation of the construction unit's application for pollutant discharge permits
Environmental risk emergency plan and drill. In response to potential environmental emergencies such as fires and chemical leaks in construction projects, the construction unit should record the preparation of an "Emergency Plan for Sudden Environmental Risk Accidents"; Has the contingency plan been registered with the local ecological environment department and conducted daily drills.
Daily environmental management system and implementation. It should be recorded that the construction project has formulated various environmental protection management systems and their implementation status.
8. Prepare acceptance monitoring (investigation) report
Acceptance monitoring report. The content of the acceptance monitoring report should include, but is not limited to, the following: overview of the construction project, acceptance basis, project construction status, environmental protection facilities, main conclusions and recommendations of the environmental impact assessment report (table), approval decisions of the approval department, acceptance execution standards, acceptance monitoring content, quality assurance and quality control, acceptance monitoring results, acceptance monitoring conclusions, and the "three simultaneities" completion acceptance registration form for environmental protection of the construction project.
Acceptance investigation report. The content of the acceptance investigation report should include, but is not limited to, the following: overview of the construction project, acceptance basis, project construction status, construction status of environmental protection facilities, changes in engineering and environmental protection facilities, main conclusions and recommendations of the environmental impact assessment report (table) and approval decisions of the approval department, acceptance execution standards, investigation of the effectiveness of environmental protection facilities, environmental impact investigation, suggestions and subsequent requirements, acceptance investigation conclusion, "Three Simultaneities" completion acceptance registration form for environmental protection facilities of the construction project, etc.
9. Formulate acceptance opinions
(1) Basic content of acceptance opinions
The acceptance opinion should include the basic situation of the construction project, changes in the project, implementation of environmental protection facilities, commissioning effect of environmental protection facilities, impact of the construction on the environment, acceptance conclusion, and subsequent requirements. The acceptance conclusion should clarify whether the environmental protection facilities of the construction project have been accepted as qualified. Members of the acceptance team should sign and confirm the acceptance opinions.
The acceptance opinions for pollution impact construction projects refer to the appendix of the "Technical Guidelines for Environmental Protection Acceptance of Construction Project Completion - Pollution Impact Category"; The acceptance opinions for ecological impact construction projects refer to the appendix of the "Technical Specification for Environmental Protection Acceptance of Construction Project Completion - Ecological Impact Category".
(2) Unqualified acceptance situation
If any of the following situations exist in the environmental protection facilities of a construction project, the construction unit shall not propose the opinion of acceptance:
Failure to construct environmental protection facilities in accordance with the requirements of the environmental impact assessment report (form) and its approval decision, or environmental protection facilities that cannot be put into operation or used simultaneously with the main project.
Pollutant emissions that do not comply with relevant national and local standards, environmental impact assessment reports (forms) and their approval decisions, or the requirements of total emission control indicators for key pollutants.
After the approval of the environmental impact assessment report (form), if there are significant changes in the nature, scale, location, production process adopted, or measures to prevent pollution and ecological damage of the construction project, and the construction unit fails to reapply for approval of the environmental impact assessment report (form) or the environmental impact assessment report (form) is not approved.
During the construction process, significant environmental pollution has not been completely controlled, or significant ecological damage has not been restored.
Construction projects included in the management of pollutant discharge permits that discharge pollutants without a permit or without a permit.
The construction project that should be inspected and accepted in stages according to law cannot meet the corresponding main project needs for the prevention and control of environmental pollution and ecological damage by the environmental protection facilities constructed, put into production or used in stages.
The construction unit has been punished for violating national and local environmental protection laws and regulations in the construction project, and has been ordered to make corrections. The corrections have not been completed yet.
The basic data of the acceptance report is obviously untrue, with significant omissions or omissions in the content, or the acceptance conclusion is unclear and unreasonable.
Other environmental protection laws, regulations, and rules stipulate that environmental protection inspections cannot be passed.
10. Fill in 'Other matters that need to be explained'
(1) Basic content of "Other matters to be explained"
The construction unit shall truthfully record the brief introduction of the design, construction, and acceptance process of environmental protection facilities, public feedback and handling, the implementation of environmental protection measures other than environmental protection facilities proposed in the environmental impact assessment report (form) and the approval decision of the approval department, as well as the rectification work in the "other matters that need to be explained".
If the relevant local government or government department promises to be responsible for implementing environmental protection measures such as relocation of residents, functional replacement, and habitat protection within the protective distance supporting the project construction, the construction unit shall actively cooperate with the local government or department to complete them within the promised time limit, and truthfully record the implementation of the aforementioned environmental protection measures in the "Other Matters to be Explained" section.
(2) Format of "Other Matters to be Explained"
The "other matters that need to be explained" for pollution impact construction projects refer to the appendix of the "Technical Guidelines for Environmental Protection Acceptance of Construction Project Completion - Pollution Impact Category"; The "other matters that need to be explained" for ecological impact construction projects refer to the appendix of the "Technical Specification for Environmental Protection Acceptance of Completed Construction Projects - Ecological Impact Category".
11. Publicity of Acceptance Report
Except for situations where confidentiality is required by the state, the acceptance monitoring (investigation) report, acceptance opinions, and "other matters that need to be explained" shall serve as the acceptance report. Within 5 working days after completion, the construction unit shall actively publicize the acceptance report to the public through its website or other means that are convenient for the public to know, and the publicity period shall not be less than 20 working days. If a website is publicly available, it should ensure that the public can easily access relevant information and should not use websites that require public registration, payment, or other methods to obtain information.
12. Fill in the acceptance information
Within 5 working days after the expiration of the publicity period for the acceptance report, the construction unit shall log in to the National Construction Project Completion Environmental Protection Acceptance Information Platform( https://cepc.lem.org.cn/#/login )Fill in the basic information of the construction project, the acceptance status of environmental protection facilities, and other relevant information, and be responsible for the authenticity, accuracy, and completeness of the information.
13. Acceptance data archiving
After the completion of the environmental protection acceptance of the construction project, the construction unit shall archive the acceptance report and other archival materials for future reference.
The acceptance report includes the acceptance monitoring (investigation) report, acceptance opinions, and "other matters that need to be explained". The drawings, "three simultaneities" acceptance registration form, on-site photos, hazardous waste disposal agreement, and transfer manifest in the acceptance monitoring (investigation) report should be complete; Other archival materials include environmental impact assessment documents and approval decisions from the approval department, monitoring reports, pollutant discharge permits, relevant agreements, environmental risk emergency plans and filing certificates, environmental management systems, records of environmental violations, environmental supervision reports, online monitoring facility acceptance reports, and other supporting documents for environmental protection acceptance of construction projects; Environmental protection design scheme, pollutant treatment facility engineering design scheme, and general simple facilities can use the supplier's product specifications.
